Vanity: Can the president ignore the court and continue with his valid executive order?

Vanity Discussion Question: Can the president ignore the court order and continue with his valid executive order?

It appears the president is acting in accordance to his constitutional powers and specifically in accordance to laws regarding immigration and has been challenged and overridden by an unconstitutionally political activist (liberal) court.

If so, can he can he continue with his valid orders controlling the actions of the executive branch? No doubt this would set up a "constitutional crisis" but this is going to happen soon anyway as it's the only way we will ever restore constitutional government, ie, the liberal activist courts will have to be toppled eventually. Why not now while we have a strong president and Republican majorities in both housees of congress?

Just askin'.

The “improved vetting process” should be to keep each and every one of them cooped up until Gorsuch is in place, and THEN kick each and every one of them out of our country.

This cold civil war thing is going too far. The left is willfully and purposefully trying to damage our country.

He should immediately issue an EO which requires that those currently admitted in violation of his 1st EO must wear a tracking device.

Great idea. I have been trying to raise this same issue. Trump can issue a new EO as quick as they can print them. He can ban all entry into the US by anyone other than a citizen. He could also slightly alter the order to accomplish his goal. I sure hope he does this soon. The breaking up of the 9th Circuit is not the answer and SCOTUS will take too long. As a side issue, Sessions is now AG. He will make sure someone argues in court that has a clue about the law. Like to see him go into Court just to piss off the Libs.

Good grief what a mess. I’ll give it another hour before I give up on POTUS.

How the hell do you take the strongest national conservative mandate in 100 yrs and hand it over to the most liberal court in the USA?

For now Congress should disband the 9th. But you can bet those inhabiting Congress do not even slightly have the courage to do anything really needed. Only a small remnant of USAians therein.

They all know that their very lives are at risk from Islam. Their families too. Saying no Islamic invasion is life threatening, and they all know it. It is just average people who have no clue about the war we are already in.

This is what I don't understand. Why is Trump abiding by derelict court orders that are clearly outside of their authority? Is he afraid of impeachment? Why would he be impeached if he was following what is clearly his authority?

If he were to be impeached by ignoring unconstitutional rulings, then we are at war. If he is abiding by unconstitutional rulings then he is surrendering to a COUP by the DemonRats.

IGNORE THE RULING, TRUMP. Have Jeff Sessions make this announcement and explain this decision has been made now that he was a DOJ AG!

President Trump definitely can ignore the 9th's illegal decision--but two freeper comments are key to the results of such an action.

The impeachment proceedings will start next week.-- Helicondelta
The permanent bureaucracy will follow the Court and ignore Trump’s EOs.-- jjotto

Best for Trump to write a new, better constructed EO that starts the clock again on the length of the ban.

Then make damn sure that Goresuch is installed to create a 9-member Supreme Court by the time the libs' new challenge reaches the day of reckoning.

The power of the Executive MUST prevail over this monstrous 9th Circus.

It would trigger an impeachment. He needs to take it to the Supreme Court, and also have his people craft an EO that will stand up to legal challenges.

He can, but the result would be a mess.

Many of the career lawyers in the DOJ would resign in protest.

ICE agents-- the ones on the front lines who have to enforce the EO-- might enforce it or they might not. If they did, the federal court would probably hold some ICE agents in contempt in order to scare the rest of them. Trump and the federal courts would then be issuing conflicting orders to the U.S. Marshals, resulting in more resignations and more chaos.

The Democrats in Congress would immediately introduce an impeachment resolution, and some Republicans of the McCain-Graham wing would join them.

In short, we would quickly find ourselves living in "interesting times."

Regarding the EO and Trump disregarding the court ruling...

I’d say that,

perhaps he can allow the court ruling to stand, and then...

issue 7 individual EOs for each of the 7 countries that are being vetted more carefully.

If he goes that way, he would not be violating that order from the 9th, and then, the states would have to re-examine each new EO individually and go from there. IN any case, the states would still have no standing to “overrule” the president on national security issues.

Here, this judiciary also subverted Congress' explicit law. In theory, these lower court judges could shut down a Declaration of War or a budget or anything; limitless power on a whim. Congress can simply immediately vacate their authority. Or, for good measure, go nuclear and approve Gorsuch.

It need not become a constitutional crisis. All that is necessary, according to Article 3 of the US Constitution, is for Congress to restrict the appellate jurisdiction of the Courts. Congress can, and did so up until the last third of the 19th century. Time to dust off that old document, the Constitution that is, and abide by its provisions. Simple enough. Case closed.

Congress decides which cases and controversies the federal courts decide (aside from a few specified in the Constitution), and it could withdraw immigration law from them altogether.

If these judges are willing to ignore the current, clearly stated laws, what makes you think they'd pay attention to a new law that takes away their power?
