A federal appeals court has maintained the freeze on President Trump’s controversial immigration order, meaning previously barred refugees and citizens from seven Muslim-majority countries can continue entering the U.S.
A panel with the U.S. Court of Appeals for the 9th Circuit upheld the ruling of U.S. District Judge James Robart, who had decided Friday that Trump’s temporary travel ban should be put on hold. The Department of Homeland Security soon suspended all enforcement of Trump’s controversial directive.
The Justice Department, representing the Trump administration, could now ask the Supreme Court — which often defers to the president on matters of immigration and national security — to intervene. The Supreme Court, though, remains one justice short, and many see it as ideologically split 4-4. A tie would keep in place whatever the appeals court decides.

And this is surprising exactly who?? This outcome was known the minute it was filed. This was always headed for the SCOTUS. It will be filed the second Trump’s justice is confirmed.
It’s the 9th circuit. The Gilda Radner of the legal world. They exist to be thrown out like an ill-mannered drunk.
All Trump has to do is,withdraw,the original make a slight change,and issue a new order.

Pardon my ignorance, but why can’t Trump just create a new EO every 8 hours. Each one would have to be argued individually. Just keep them running.
So now any state can get standing about any issue that is strictly reserved for POTUS like this one is..way to go liberals...may you rot an burn in hell

And I’d be surprised there isn’t an answer by at least mid day tomorrow that is bullet proof and air tight. Maybe even tonight.
S.O.B.s. How can we have won the house, senate AND the Presidency (and have half of the Supreme Court) and STILL be losing to the DemonRats???!!! He is following a law on the books that other Presidents have used in the past; so how can this stinking court override a law?
Trump should just write another executive order, change the wording and enforce it. The damn gutless, spineless, ball-less Republicans need to write legislation and help Trump.
This bogus court determined the inconvenience of foreigners Trump’s the security of American citizens.
If Trump is listening, one of his agenda items should be to use the Congressional majority he has to redistricting the 9th Circus, restricting it to San Francisco and create numerous new district federal courts manned by conservative judges of his choice.
My understanding of this is they can ask the full 9th to rule on this temporary order, but the Seattle Federal Judge will have a full hearing on this.. If he rules against Trump then it will go to the 9th again then to the United States Supreme Court by then I hope Trumps pick has been seated..
I don't know but I heard every 12 hours and he should have one written now and rescind the old one

The President could make clear that America's safety & security is at stake by declaring a temporary National Emergency.
Let's see how the 9th Circus handles that hot potato.
Or just issue an EO that says we halt ALL immigration (legal or otherwise) until we can get things under control.

It was a huge strategic mistake for the President to appeal to the courts. Given the make-up of the 9th Circuit, they were never going to rule on the merits of the lower court judge’s restraining order, vis a vis established law and the Constitution.
The court is in a state of insurrection, and should have been ignored by the President and his cabinet. He should have slapped down the Seattle judge on day one, and had Sean Spicer read out the relevant federal statutes, Supreme Court decisions, and sections of the Constitution to the people.
Now the case has to be appealed to the Supremes, who will deadlock 4 to 4, thus rendering the decision of the 9th Circuit as a precedent and OVERTURNING established law and the Constitution.
This cannot stand, or there is no more America.
