Car-theft victim handed over to immigration agents sues SF

A car-theft victim who sought help from San Francisco police only to end up in federal immigration custody for two months filed a federal lawsuit Tuesday against the city, the Police Department and the Sheriff’s Department for violating the sanctuary city ordinance.

Pedro Figueroa Zarceno, a 32-year-old Mission District resident, says officials breached the ordinance and his right to due process by alerting U.S. Immigration and Customs Enforcement, known as ICE, when he went to retrieve a police report about his stolen car at Southern Police Station on Dec. 2, 2015.

Figueroa was the subject of a deportation order arising from his failure to appear at an immigration hearing in San Antonio in December 2005, and from a 2012 conviction for drunken driving, authorities said.

So you ignore our laws and sneak into our country, have your day in court and choose to ignore that and then once again ignore our laws, endanger American citizens while driving under the influence. Now you want to use our laws, our courts to sue us. Please Trump take office soon.

Let’s see if we can use this case challenge to declare “sanctuary cities” unconstitutional.

See, when the California marriage amendment came before the Supreme Court, Gay loving Jerry Brown didn’t fight to uphold the law and those who sponsored the amendment were told “they didn’t have standing” (which is a crock) so it was kicked back down to the homofascists in the state who ignored the will of the California people.

Bring it.

!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Why is he still here?

Deportation order means deport him.

He now has an additional drunk driving conviction.

We should not wait until they actually kill someone before deporting illegal aliens.

Judge: San Francisco can’t be sued over death of Kate Steinle who was killed by illegal immigrant

SAN FRANCISCO – A federal judge says San Francisco cannot be held liable for the death of a woman who authorities say was shot and killed by a man who was in the country illegally.

U.S. Magistrate Judge Joseph Spero dismissed wrongful death claims filed by the family of 32-year-old Kathryn Steinle against the city and Sheriff Ross Mirkarimi.

The man charged with murder in Steinle’s July 2015 slaying, Juan Francisco Lopez-Sanchez, had been released by sheriff’s officials months earlier despite a request by immigration officials to keep him behind bars. Lopez-Sanchez has pleaded not guilty.

Spero said in his ruling on Friday that the sheriff did not violate state or federal law by prohibiting his deputies from telling immigration officials when an inmate is released. An email to an attorney for Steinle’s family was not immediately returned.

Don’t forget the laughable irony that he wants enforcement of our laws over his stolen vehicle.

How can he file a Federal lawsuit against a city for failing to violate Federal immigration law?

As much as I would enjoy seeing SF lose just about anything, this suit should be dismissed, and the criminal should be imprisoned long enough to discourage return and then deported.

Hang in there Pedro. My money is on Trump throwing your ass over the wall before your suit goes to trial... and, after Trump shuts off the Federal $ you’ll be lucky if SF can print you an IOU, much less pay you, anyway.

I thought this nonsense was settled a few years ago when Arizona lost on state immigration laws and that the Supreme Court said Fed immigration laws are supreme.

Bye bye.

Fine. They didn’t *have* to inform ICE.

But, FAILING to uphold/enforce the law (deportation order, DUI, etc.), which led to the death, nay DIRECTLY CONTRIBUTED\ATTRIBUTED, of this lady....*THAT*, the ‘judge’ won’t touch (if they allowed it in court to begin)??

The (LAWFUL) Citizens are denied their Rights by the institute designed protect instead.

Liberals insist on having it both ways...they have had things working that way. States were not allowed to enforce immigration laws, but cities and states were allowed to ignore immigration laws.

Unreal. In a just world the lawsuit would be dismissed and the attorneys sanctioned. Also illustrates the irony and incompetence in SF - they release Kate’s killer but turn over a crime victim to INS. Trump should declare martial law and put down the rebellion in this province.
