GOP Rep Introduces National Concealed Carry Reciprocity On Day One of New Congress

On January 3–the first day of the 115th Congress–Representative Richard Hudson (R-NC-8) introduced national concealed carry reciprocity legislation.

Hudson's office published this summary of the legislation:

Rep. Hudson's bill, which is supported by major pro-Second Amendment groups, would allow people with a state-issued concealed carry license or permit to conceal a handgun in any other state that allows concealed carry, as long as the permit holder follows the laws of that state. It also allows residents of Constitutional carry states the ability to carry in other states that recognize their own resident's right to concealed carry.

Note: Hudson's legislation not only establishes national reciprocity for concealed permit holders but also national reciprocity for residents who live in states that require no permit for concealed carry.

So, if Illinois offers Concealed Carry, but it is almost impossible to actually acquire, if I, a CC carrying person from KY visit Illinois, I need only read up on the rules for conceal carriers in Illinois and I’m good to go if this passes?

That would sure tick off Illinois (not to mention NJ).

I like it.

Through the equal protection clause, as was used to justify gay marriage, ALL states would have to offer CCW as an option, and likely shall-issue CCW at that.

BEtteer yet...it would allow Concealed Carry in NYC.

Even I, as a NYS CCW holder who doesn’t live in NYC can’t carry my weapon there. If this passes, I could.

This legislation is actually authorized under the Article IV Full Faith and Credit Clause, which gives Congress authority to enact legislation to ensure that the acts of one state are given full faith and credit in all states.

Illinois has had legal concealed carry for two years now and, despite predictions to the contrary, the sky has not fallen. Permits cost $150 and are valid for five years, while non-resident permits can be obtained for $300.

The 16-hour training requirement is extensive as Right-To-Carry states go, but Illinois does have strong self-defense laws. The law has a preemption element, so cities cannot opt-out.

Illinois resident permits are recognized in 25 states.

In my CCW class years ago, the instructor told me that if was driving through Illinois the safest thing to do was stop at the state line, put my firearm in the trunk, and get it back out after I crossed the line again.

Hope this changes.

I agree 100%. 2 summers ago, the family and I traveled from TX to NJ, then down to DC on the way to FL, and then home. I carried everywhere but in DC (we stayed in MD, and only went to the Smithsonian during daylight hours). I had to break laws in MD and NJ just to be able to protect my wife, kids and myself from people who don’t hesitate to break a myriad of laws to steal my stuff. ENOUGH of that crap! If marriage MUST be recognized across state lines, then so much a specifically-enumerated right.

Now that this part of the rollback of the Prison-State has started, I’m waiting for the Hearing Protection Act and the proposed elimination of the 1986 prohibition on civilian ownership of post-’86 full autos. I’ll believe that the Congress is serious when these are not just proposed, but passed and signed into law.

As I understand this law, states will still have the right to dictate magazine capacity and the types of rounds that can be loaded in them. As an example, in NY the mag capacity is 7 rounds? I also believe hollow points aren’t allowed in NJ.

New York is 10 rounds maximum, the courts held the 7 round limit was arbitrary.

New Jersey bans the use of hollow points, big no-no if you are caught with them outside of your house.

It is actually easier for a resident of New York get a permit to carry in New York, outside of the NYC than it is in New Jersey. In new Jersey you need a judge to sign off on it, and they generally will not do this.

Yes, but Equal Protection means that places like NYC AND Cali will have to give out permits to their residents as well even if they do not want to. That’s how all 50 states got stuck with being forced to issue gay marriage licenses.

Stuck in CA, so the marriage thing is already a given regardless of what the SCOTUS or feds decide; love the idea of a big FU to Jerry and the Dems.

True, but New York does not issue non-resident permits, and in a unique act of defiance does not allow the free passage guaranteed by natural law, the Constitution, and FOPA.

Even New Jersey will allow you to use FOPA in a roadside stop (assuming you are following the rules). NY will arrest you, book you, make you stay in jail until a probable cause hearing, and then say, "well, we will allow you to use FOPA as an affirmative defense at your trial".

I grew up shooting in Nassau County NY, and it's really unbelievable how fascistic the government there and in NYC has become around this issue.

There are lots of pros and cons to national reciprocity, which I won't go into. But one thing Congress absolutely can and should do TODAY is grant 50-state reciprocity within DC, over which Congress has total and unlimited authority.
