True story.
More people should be concerned about ionizing radiation, particularly from medical imaging. I digress...

My question is, how could they get a conviction if the machine was incapable of doing what it was intended for?
There may be precedent for this. Back in the 80's in NYC a robbery suspect put up a fight while being arrested. He spat at the cops while yelling he was HIV positive and hoped they would die from AIDS. He was not only convicted for the robbery but was found guilty of attempted murder because he THOUGHT he was infecting the arresting officers.
