I might agree, had he been nominated, but for now, he is just stated to be on a list of those qualified to serve. No conflict there. None.

Not like, say Elana Kagan ruling on Obamacare cases, or Ginsberg publicly speaking contemptuously about our Constitution, and disparaging the incoming president. Will Ginsberg recuse all Trump Administration cases. I think not.

They should not be forced to recuse themselves over something that is completely outside of their control.

If Trump came out tomorrow and listed every Obama-appointed judge in the country as a potential Supreme Court nominee, would they all be forced to recuse themselves from every case related to the Trump administration?
