I believe the said that if he were king and there was no Constitution, he would make it against the law to burn the flag.

And being that Justice Scalia understood that he was not king and we did have a Constitution with a First Amendment, he voted with the majority in Texas v. Johnson.

He followed the Constitution..not his personal beliefs. He did not think SCOTUS should be tenured legislators.

Scalia, et al’s mistake was in accepting the PREMISE of the commie lib Constitution haters on the Court, that burning our National Banner is SPEECH. Some great travesties in history were perpetrated by the SCOTUS, and IMHO, this was one of them.
