Honestly that sounds like the DOJ is blocking the FBI.
He said that the DOJ has not approved a warrant.
Technically it's the DOJ that goes to court and ask for a warrant.
Obviously this is why special prosecutors should be appointed. We are in a Constitutional crisis.

Huma lied under oath to the FBI. She said she’d turned over her emails and they were not on other devices. That’s a crime.
Re warrant :
A warrant defines the scope of the investigation. They had a warrant for evidence against Weiner but in the course of the investigation discovered evidence of another crime(Huma) they have to petition for another warrant that defines the scope of the new investigation. New info that they have come across otherwise could be ruled inadmissible in a court of law.We

The FBI has probably a warrant requested by the DOJ ... when they got the Weiner machine ... didn’t need a separate warrant when the emails were discovered incidental to that investigation .... pigs just rooting in the sty.
