There are certainly grounds for a civil lawsuit, but more importantly there are clearly grounds for asserting criminal charges for violating federal and state laws by accessing and publishing private tax returns. The New York Times and every individual involved is potentially criminally and civil liable for their involvement.

At least one other Republican candidate has sued for false statements in a campaign. In Roosevelt vs. Newett, Teddy Roosevelt sued for slander against a newspaper and won. He said he sued to restore his good name.
