UN makes power play against Trump

International governments have made a power play against Donald Trump by ratifying an international climate deal earlier than expected, effectively preventing him from “canceling” the deal as he has promised to do.

The European Union’s Tuesday decision to join the Paris climate deal will push the deal over the threshold for ratification; it will formally take effect in 30 days.

That means Trump, should he be elected president in November, could not “cancel” or renegotiate the terms of the agreement. President Obama committed the United States to reduce its emissions by 26 percent to 28 percent by 2025 as part of the deal. The agreement is nonbinding, so Trump would be free to ignore it if he wins the White House.

Constitutionally he is prohibited from taking any action on a Treaty that has not been approved by the Senate. Too bad the current occupant of the White House disregards that document.

Formation of the United Nations:

" Alger Hiss (November 11, 1904 - November 15, 1996) was an American lawyer, government official, author, and lecturer. He was involved in the establishment of the United Nations both as a U.S. State Department and U.N. official. Hiss was accused of being a Soviet spy in 1948 and convicted of perjury in connection with this charge in 1950.

On August 3, 1948, Whittaker Chambers, a former Communist Party member, testified under subpoena before the House Committee on Un-American Activities (HUAC) that Hiss had secretly been a Communist while in federal service. Chambers had previously testified under oath that Hiss had never been a Communist or a spy, and Chambers would admit, under oath, to other instances where he had committed perjury under oath. Called before HUAC, Hiss categorically denied the charge. When Chambers repeated his claim on nationwide radio, Hiss filed a defamation lawsuit against him.

During the pretrial discovery process, Chambers produced new evidence indicating that he and Hiss had been involved in espionage, which both men had previously denied under oath to HUAC.

A federal grand jury indicted Hiss on two counts of perjury; Chambers admitted to the same offense but, as a cooperating government witness, was never charged.

Although Hiss's indictment stemmed from the alleged espionage, he could not be tried for that crime because the statute of limitations had expired."

"Mayor Giuliani, who said the international body was on the verge of becoming a laughingstock, began talking half-seriously about the fancy hotels and apartment buildings that could be built on the site if United Nations members carried through on their threats to leave.

Speaking to a group of reporters in his office, he said: "They are making a little bit of a joke out of the U.N. by threatening to take a parking violations case to the World Court. It was not put together by treaty to argue out special-interest parking situations for diplomats."

Instead of settling wars and resolving human rights violations, he said, the institution was "defining diplomacy down" by arguing about parking tickets.

Mr. Giuliani was no kinder to the State Department, which just last month, in a public ceremony, signed an agreement with the city to force diplomats to pay their parking tickets on the threat of removing their plates. With State Department officials now seeking to remove the teeth from that agreement, the Mayor accused them of cowering to overblown United Nations threats to leave the United States over the parking rules, and said the diplomats’ bluff should be called.

"If they’d like to leave New York over parking tickets, then we can find another use for that area of town," he said. "It happens to be just about the most valuable real estate in the world, not just in the United States. That is enormously valuable real estate, and with the vacancy rates that exist in the city of New York, can you imagine what we could do with that?"

In case anyone thought he was bluffing, he had city lawyers check the United Nations lease to determine who gets the riverfront property if the institution leaves town.

It is well established in US law that current governments cannot bind future governments in any way. If nothing else, Trump can *abrogate* this and other treaties.

Even simpler, Obama tried to evade the requirement for US senate ratification by declaring this to be a “sub treaty agreement”. So Trump can declare it to actually be a treaty, and send it to the US senate to turn down. That officially kills it, so it cannot bind the US in any way, no matter what the UN wants.

Trump should go a step further, however. He should ask the Chinese and the Russians to both build new versions of the UN in Beijing and Moscow, with the idea of “rotating” the UN out of the US for 50 years to Beijing, then for 50 years to Moscow.

If the UN could actually *survive* this, then theoretically it would come back to the US. But practically speaking, we would then encourage other world capitals to have their own UNs. So we would likely never see it again.

Personally, I would love to see all those 3rd and 4th world jerks interacting with the Chinese, who would take a very dim view of their antics.

There he is again... “Somesay”. This deal is a treaty. Obama can’t act on his own. He needs 2/3 from the Senate the treaty hasn’t been ratified, and won’t be. What is the UN gonna do?

The UN is nothing more than a VIP lounge for dictators and terrorists. Even though it's an excellent example of mid-20th century architecture it's time to, in the words of the babydaddy of Michael Brown TEAR THIS BITCH DOWN!. What 's the worst that will happen? Real estate values on the Upper East Side plummet? High priced hookers and their pimps are out of work? Knock it down, then sell the site to Trump for $1. Let him negotiate with the Mohawks and the NFL (with a stipulation that they discipline the overpaid crybabies who refuse to stand for the National Anthem)to biuld a casino and stadium there so we can bring the Jets and Giants back to NYC where they belong!

Was it ratified by the Senate? Obama can’t enter into treaties w/o the Senate ratifying them.

I wish Trump would notify the UN that the treaties signed by prior presidents, but not ratified by the Senate, are no longer recognized by the US government.
