Are you saying the cable channels aren’t “broadcast” by direct-to-home satellite? Isn’t this BROADcasting?
The frequencies used to broadcast from DISH and DirectTV satellites are licensed to DISH and DirectTV. The FCC has no authority to regulate how DISH and DirecTV use them.
Fun fact: direct broadcasting satellites actually use the same set of frequencies. But, they don't interfere with each other because you use an antenna with a very narrow beamwidth to select the satellite(s) you want.
