Three Steps to Deal With Illegal Immigration in the U.S. and Citizenship isn't One of them

How to deal with approximately 11 million illegal immigrants in this country is no double the hot campaign issue in 2016 and likely will determine the outcome of this presidential race. The Democrats insist the only way to move forward is to grant illegal immigrants a path to citizenship. That is a simple but false solution because it isn't supported by historical facts as well as what incentivized illegal immigrants to be here to begin with.

First, let's review the historical facts. According to the Pew Research Center, in the 1990s, only 38% of legal immigrants became naturalized U.S. citizens. That number has gradually climbed since then. In 2011, 56% of legal immigrants in the U.S. became naturalized citizens, but the remaining 44% (9.7 million legal immigrants) chose not to become U.S. citizens even though they were eligible. Hispanic immigrants made up the largest immigrant group, but their naturalization rate was only 46%, compared with 71% of all other legal immigrants. Legal immigrants from Mexico have the lowest naturalization rate of 36%.

These data shows that evidently, citizenship is not something motivated many immigrants, legal or illegal. Not surprisingly, past effort to grant legal immigration status to illegal immigrants failed to stop the inflow of illegal immigrants as promised. The clearest example was President Reagan's Immigration Reform and Control Act of 1986, which offered three million illegal immigrants amnesty. The number of illegal immigrants continued to climb since the law's passing. According to Pew Research, the unauthorized population grew by an average of a half million a year between 1990 and the mid-2000s and peaked in 2007 at around 12 million.

It's crystal clear that citizenship isn't a motivation factor for many illegal immigrants and thus, granting a path to citizenship is not a solution. In addition, our legal immigration system already has a massive backlog. Imagine what would happen if we stuffed 11 million new applications into the pipeline. We cannot keep trying to help illegal immigrants by punishing legal immigrants.

So what motivated illegal immigrants? Among the estimated 11.3 million illegal immigrants in the U.S., 8.5 million of them are in the labor force as of 2014. On a percentage basis, illegal immigrants are about 3.5% of our nation’s population and about 5% of its labor force. It’s worth pointing out that illegal immigrants arealarger shareofthelaborforcethanofthe totalpopulation.

Although close to 45% of illegal immigrants come from Mexico, Mexicans’ share of illegal immigrants peaked in 2007 and has been declining since. Ana Gonzalez-Barrera from the Pew Research Center estimated that there were 140,000 fewer Mexicans living in the U.S. in 2014 than in 2009, and that the net flow from Mexico to the U.S. is now negative. She credited the decline to the U.S.’s economic recession in 2008 and the improving Mexican economy at the same time.

Obviously, many illegal immigrants are economic migrants who came here to find a better job and a better life, but not all of them want to stay in the U.S. for the rest of their lives. Many wouldn't have brought their families here if they can travel back and forth between U.S. and their home countries without worrying about being stopped at the border.

History shows granting temporary work visas to economic oriented migrants is the best way to reduce the incentive and the numbers of illegal immigrants.

When World War II created a labor shortage in the U.S. after many American men were drafted into the U.S. Armed Forces. the U.S. and Mexican governments created a temporary program to bring Mexican agricultural labor into the U.S. On August 4, 1942. The program was officially referred to as the Mexican Farm Labor Program, but most people know it as the Bracero Program (bracero in Spanish means “manual laborer”). The Bracero Program wasn’t an immigration program. It allowed Mexicans to legally take temporary agriculture work and, later, railroad work in the U.S. with nonimmigrant status.

The program lasted until 1964. Between 1942 and 1964, over 4.6 million Bracero labor contracts were signed. During which period, the number of illegal immigrants was reduced by 90%. It’s not difficult to see why. There were no legal hurdles for Mexican workers to get a work visa, which greatly reduced the incentive to cross the border illegally. There were few compliance requirements for U.S. farmers, and with a guaranteed supply of legal workers, there was limited demand for illegal workers.

Therefore, the solution to illegal immigration already in the U.S. can be as simple as three steps and granting citizenship isn't one of them:

Step 1. Illegal immigrants who can show they currently are employed and with no criminal record should be granted temporary work visas after they pay a fine. A work visa will allow the visa holder to work legally in the U.S., paying income taxes and traveling in and out of the U.S. with no constraints. These benefits should meet what most illegal immigrants are seeking. But because a work visa is not an immigration visa, the visa holders will still be considered non-resident aliens and therefore will not have access to federal means-tested welfare benefits. The work visa will be good for three years and can be renewed as long as the applicant is employed.

Step 2. If illegal immigrants have brought their families with them, they ought to pay a fine for their families too. Their family members, excluding children who were born here, will get temporary visitor visas. The length of their visa should be the same as the working visa, and they can renew their visas as long as their primary family member’s work visa is valid. Since a visitor visa is also a non-immigration visa, these visa holders will not have access to federal means-tested welfare benefits either. If any these illegal immigrants want to become legal permanent residents, they will have to go through the same application process as other legal immigrants.

Step 3. Any illegal immigrant who has a criminal record, including creating a false identity or using a fraudulent Social Security number, will be deported immediately and will not be eligible to apply for any U.S. visa for five years.

We know how to solve our illegal immigration problems. These ideas have been around for many years. What we have been lacking are a political will to do the right things and someone who can articulate these solutions in simple and candidate manner that will win support from most of the Americans.

They need to enforce the laws that are on the books, especially the ones Obama has ignored. Many overstay their visas with no consequences. They are illegals. The 19 hijackers on 9-11, most if not all had overstayed their visas. The was 2001 which means the Bush administration as lax in enforcing our laws. A visa has a time limit on it for a reason.

Helen Raleigh,

I cannot disagree with you more. You do not make legitimate what is willfully illegal.

1. How about you announce a grace period of say 120 days. Any illegal in the country after, by law, will never get legal status and never get citizenship (and take away all their possessions, including bank accounts.

2. Empower local and state authorities to arrest and deport illegals. And let these authorizes collect fines for their benefit.

3. Offer rewards for turning in companies/individuals who employ illegals.

Exactly, but the ones that overstay their visas are those who either come with a student visa or with visitors visa. Those that come with an immigration visa do not and they receive a green card that identifies them as legal residents

I’d say that’s another unicorn (not using any taxpayer provided ‘services’) but, to answer your question: The same as I’d hope every OTHER Citizen would do. AKA: their due diligence (IE: Ask for their license and insurance, verify their references and the like).

Now, you talking picking lettuce\tomatoes\seasonal work...

Hell, I think schools, and many other ‘govt services’ should return to service orientated: Those who use PAY.

Used to be, maybe even more-so today w/ Yelp and the like, word of mouth would be enough to shut down people thought others might wish to avoid. “Hey, guy\co X employs illegals!”.

Let the market decide.

Course, someone burns their house down so Paulo can work for $5\hr cheaper, I’m sure the insurance company would have some say as well...

Step #2: call them sneaks, because that’s what they are. They sneaked across the border or effectively sneaked in by getting visas that they allow to lapse without leaving.

Oh, I said *nothing* about ignoring the obvious.

Unfort., govt isn’t doing its job on multiple fronts (be that State > Fed); calling the cops\ICE+ just begets a revolving door effect (”Oh, you *promise* to come back to trail? Well, we’ll let you out until then.”). And, no We shouldn’t stop doing our due diligence.

That doesn’t mean govt gets (nor has the authority) to saddle BIZ with the attempt to clean up the mess for ‘em (while they wash their hands of the matter). And, if biz doesn’t do a ‘good enough job’, get fined out the wazoo.

You get govt out of the things it shallNOT be doing (welfare, sanctuary cities, etc.) and back to that which it SHALL (protecting Citizen Rights\border) and the illegal problem mostly disappears.

I’m all for a wall, if need be. But, it should be the FINAL task in a long laundry list, instead of burdening (or crushing) everyone else.

It seems to me that you are dancing around a very important part of our illegal aliens issue, those who are already here.

What is governments role in this issue?

How do we identify them, and once identified, how do we make sure they have every incentive to quickly leave on their own accord?

Based on life’s experiences, I know that there are way too many Americans who simply look the other way, or even enable these illegals to stay.

I believe government has a role to force these recalcitrants to do their moral obligation to, at a minimum, ‘shun’ these people.

I cannot see how expanding govt, to further infringe the Rights and Freedoms of We the People will help in either case...

Good question. Aside from the visa over-stays and the like, how DOES one identify a ‘gate jumper’ (aside from an all seeing, all knowing Big Brother)? IMO, it sure isn’t to make EVERYONE else subservient to Fedzilla.

BUT, if we still were a service oriented economy, we’d have a damn easier time finding ‘em.

Like any large endeavor, it’s a boon...until the project is ‘complete’. True, it’s not going to crush anyone, but (my $.02), a bill not needing to be paid.....yet(?).

Do appreciate the civil back-n-forth @ least. Bigger/better minds than mine, I’d think, have more ready solutions for the task at hand.
