A liberal Court could end long-term solitary confinement. It could mandate better prison conditions in general, making it more costly to maintain mass incarceration. It could conceivably end the death penalty. It could uphold tough state campaign finance rules and start to move away from Citizens United. It could start to develop a robust right to vote and limit gerrymandering. It could strengthen abortion rights, moving toward viewing abortion rights as a matter of equal protection for women.

If Donald Trump wins in November, this is all moot. But if he loses, as polls increasingly indicate, the dawn of a new era of liberal jurisprudence could be upon us.

There should never be allowed to be a fully liberal or fully conservative supreme court.

You read it there, taxpayer-funded abortions, more violent criminals let loose, the death penalty overturned, voting rights for criminals, illegal aliens, and dead people, as well as undermining the 1st and 2nd Amendments.

This more than anything else is what’s at stake.

Liberals never look into the future..If the liberal supreme court does that ,a conservative court can to.If Trump wins in November ,will libs scream about his use of executive orders?Of course they will.All he has to do is smile and say,I`m just doing what Obama did .I`m following his rules.If you like your rules,others can use them against you.

stare decisis is a made up/bull feces legal "tradition" that can easily be superceeded by a majority which again makes that concept laughable under a "living Constitution". Respect to the fundamentals of the Constitution can be ignored at will. What makes a sane person think stare decisis is immune to deference as well?

Also stare decisis is based on some awful decisions as well, so who cares. The legal profession is just a haven for the top notch BS artists to have an arena to play in and be well compensated for their efforts. Natural Law/Common Law are victimized by the well skilled "artists", yeah for bad civil laws that pervert the logical components of Common Law.

Unlike the scotus that fast tracked Obamacare and same sex marriage. All you need to know is Reagan (or Nancy) nominated Justice Kennedy despite his known same sex affiliations and the House of Bush Chief Justice Roberts. So much for 3 decades of voting republican.I guess the oligarchs have ways I cannot comprehend.
