According to the St. Louis Post-Dispatch, the driver did not see him in the road. That group was apparently protesting in a manner which can distract drivers. With dozens of protesters on the far shoulder of this road, it's easy to see the driver remained as far to the left as possible to avoid those she saw in the group...only to miss the one foolishly standing in the road directly ahead of her. It's called consequences. This degree of stupidity should be painful.

No arrests? The person who accidentally hit the person standing in the middle of the road did nothing wrong, while person who was “protesting” in the middle of the highway was the one breaking the law. The person that shot bullets into the woman’s car committed assault with a deadly weapon at least, and possibly attempted murder.
