When the state sent 2,500 volts through the body of murderer Richard Lee Whitley on Monday night, a little bit of Timothy Kaine died, too. It's not that Kaine, Whitley's lawyer, thought his client was innocent. Whitley had a long criminal history and had confessed to the 1980 murder and sexual assault of an elderly Fairfax County neighbor.

I don’t call someone who defends a brutal murderer a “bleeding heart.”
A bleeding heart is what happened to me when a stray kitten wandered into my yard and I ended up taking care of it for the next 18 years (and counting).
A lawyer who tries to get a guilty client off the hood with a lenient sentence or acquittal is someone without empathy.
Hillary got a rapist off scott-free. So why wouldn’t she pick a lawyer who tried to get a murderer off? Even if he isn’t as good a lawyer as she is, since he failed.
The essence of Kaine’s argument against the execution of Whitlley was that Whitley was mentally incompetent to stand trial. I don’t know the law in Virginia (I moved away 30 years ago), but in Georgia the defense must prove that the defendant didn’t know that his actions were wrong or that the defendant cannot assist his lawyer in his defense. It’s difficult to believe Kaine’s claim that neither of these issues came up in the original trial.
