Virginia court invalidates Gov. Terry McAuliffe’s order restoring felon voting rights

Dear friend:

Huge victory! Late this afternoon, the Virginia Supreme Court ruled that Governor McAuliffe’s executive order granting a blanket restoration of rights to felons was unconstitutional.

This is a triumph for the Constitution and the rule of law. The Court directly rebuked the Governor, saying “Although the Governor is entitled to champion his views, he cannot do so in contravention of law.” Read the whole opinion here.

For the last 3 months, Governor McAuliffe has been trumpeting his executive order, even as numerous problems were found. McAuliffe signed it despite Governors Kaine and McDonnell concluding that such action was unconstitutional. Today’s ruling proves that in Virginia, at least, no one is above the law, and the Constitution exists to restrict unlawful actions, even by the Governor.

I was proud to help lead this historic effort, but many deserve thanks. Once General Assembly Republicans decided to sue the Governor, voters Bill Cleveland, Marianne Gearhart, Brett Hall, and William Slemp agreed to serve as petitioners. Our lawyers did an outstanding job preparing briefs and arguing the case. Ultimately, our arguments based on history and the text of the Constitution carried the day.

Now let the investigation of the punk start. This will certainly NOT cause a Florida like Election Day problem. These people are used to not voting and not many will show up. Only 12,000 of the 200k had bothered to register anyway. End of story. Go away Democrat voter fraudsters.

I agree with you and have never understood why once a person who commits a felony should lose the right to vote or possess a gun for the rest of their lives. Once they do the time and get off probation their rights in these areas should be restored. We aren’t supposed to be a third world communist tyranny but it is closer to what we are becoming than a land of freedom. It doesn’t take much these days to possible become a felon and I think in the near future conservative Christians living their faith will likely put one in that category. Ignore the shallow ethically challenged “conservatives” around here.

Why is a Dim Governor allowed to posess, let alone use, an assault pen? I’m sure that pen is full auto, and hence, illegal—according to all the other dimocrats. Ironic he should use a banned weapon to restore voting rights to ex-felons not allowed access to even a single shot .22

I didn’t see in my question about babysitting. Borrowing cars or picking up my wife. My question limited to the right to vote. What is the risk of allowing them to vote? You just don’t want them to vote, because you know it is likely that they will vote for a democrat not because you care about living in a free society protected by the constitution. Another person already gave me the answer if you cared to look their the comments you POS.

You are the one who is against law and order. you are the one who wants to deprive a citizen of rights. I am not a liberal. I love Trump. I love this country. However, I do not agree with rescinding a felons rights away from them after they served their sentence that ideally was given to them by a judge and jury that was impartial. Are we to kick them while they are down. Are we to be unforgiving? What about the reformed? What more can we ask of a felon after they are sentences and completed it. You are the anti-American? Think about it, one day it might be a felony to have a gun, and they will withhold your rights to vote. You are a ignorant jackass.

YOU are whining and bitching about gun ownership. However, there are some states that re making it a felony. So the gun owners are felons and lost their right to vote. You cannot read and you have comprehension. You cannot even see what is coming down the pike with thought crimes and hate crimes. Where in the constitution does it say, if you are convicted of a felony, you lose your right to vote for life. you want to be a conservative, and don’t even consider who is considered a felon. Right now you think it is gang bangers and thugs. But tomorrow it might be YOU.

Thank you for your kind insight. Apparently to fit in on this site, I should say things like “felons deserve hell on earth until they die no matter what their infraction is.” There is no room for compassion and forgiveness in them.

Well, thankfully we are not a tyrannical 3rd world state, and as you pointed out that we are heading that way.

You need to check your facts. Along with losing the right to vote, dishonorable discharge can also lead to loss of the right to possess a firearm, depending on the jurisdiction.

Virginia has a method in place, to restore the rights for someone convicted of a nonviolent felony. We expect our governors to examine cases on an individual basis. The whole problem in the case we are discussing, stems around the fact that this man has taken it upon himself to issue a blanket pardon that includes violent felons and sex offenders. This method, however, does require the individual to take some responsibility and to apply for the pardon.
