“Now they can pull you over, tell you they suspect you of being drunk, force you to blow.”
They cannot “force” you.
SOP
1. Cheap aftershave in center console used liberally when being pulled over.
2. Roll down the window enough to pass through required docs.
3. Eyes straight ahead, answer questions in yes or no. Questions meant to get you yapping like “where you headed” in as few words as possible.
4. Never get out of the car until you are told you are under arrest.
The last thing a traffic cop wants to do is call a supervisor involved. Use that.
I’ve seen enough needless carnage from these idiots who think they can “handle it,” I’m ambivalent on this. If there is enough probable cause to pull a driver over - weaving, no headlights at night, other blatant traffic violations, obvious smell of alcohol, etc - then there is already a good reason to acquire more evidence. This isn’t an issue of self-incrimination.
“I heard a lawyer say always insist on a blood test.”
Because in most cases, it takes much longer to administer.
How about those so wasted they drive right into a well posted DUI checkpoint?
After the test then you can be robbed with those scanners that swipe your money from your accounts like Oklahoma wants to use.
A DUI cost about $2,000 in fines and court costs. Then you get the license back. As much as it is a safety issue it is also a scam for money.
Drunk driving is nothing more than a political crime. It used to be the police would either drive you home or call someone to get you.
Me too, but that ship sailed a long time ago, when they ruled fingerprinting wasn’t a 5th amendment violation.
A LEO friend of ours says that “no headlights at night” is the best predictor of DUI apart from obvious lane weaving.
I've been one, and yes, that is a major indicator. I'd even given them the benefit of a doubt by flashing my headlights off and on a couple of times as a gentle reminder. The drunk ones never got it - and I mean NEVER.
So is killing a child on a bike while drunk?
“”Drunk driving is nothing more than a political crime. It used to be the police would either drive you home or call someone to get you.””
Up until a LEO got sued because the suspected drunk was dropped off at home and after the officer left he then got into his other vehicle and killed someone.
As a LEO myself, I get a warrant for blood, if they refuse that, I cite for interference and write a damn good report and go to trial.
