Rule of law in Obama’s America
The Journal ^ | 6/18/2016 | Mike Holz

Posted on 06/18/2016 5:53:42 AM PDT by Elderberry

"Clearly, there seems to be a lack of knowledge about or adherence to the duties of professional responsibility in the halls of the Justice Department. ... The misconduct in this case was intentional, serious and material. In fact, it is hard to imagine a more serious, more calculated plan of unethical conduct." - U.S. District Court Justice Andrew S. Hanen

That was District Court Judge Andrew S. Hanen's reaction when he discovered that Department of Justice lawyers had lied to him regarding the Obama Administration's issuing of 100,000 expanded work permits for undocumented immigrants. This action violated Judge Hanen's prior ruling that temporarily blocked the President's illegal executive action on what the President would call immigration reform. Judge Hanen had discovered that DOJ lawyers had misled him as to when the Obama administration would implement the directive.

Judge Hanen was rightfully outraged, but he shouldn't have been surprised. Both of Obama's attorneys general have been lying to judges, Congress, and the American people for as long as the President has been in office; so have both of his secretaries of state, his director of homeland security, his CIA director, members of his department of defense, and his current and former white house press secretaries. They take their cue from their boss, who has also been lying to the American people for as long as he's been in office.

Let's take this angry judge dealing with Obama's Justice Department. In December of 2014, the state of Texas, along with 25 other states sued the Obama Administration for implementing through executive action, what they felt was an unconstitutional policy of granting what amounts to legal status to illegal immigrants with American born children. In February 2015, Judge Hanen issued an injunction against the implementation of this executive action, which included denying a DOJ request for a temporary stay on the ruling while the litigation wound its way through the appeals court process. The appeals process proceeded through the remainder of 2015, with Judge Hanen's ruling being upheld by appeals courts right up to the US Supreme Court, which, in January of this year, agreed to review the case.

Remember that denial of a temporary stay of implementation of this immigration program? Guess who ignored it. The DOJ lawyers had either lied to, or misled Judge Hanen on the status of over 100,000 illegals, who had been implemented into this program and were not removed from the rolls. The judge has accused these attorneys of conducting a "calculated plan of unethical conduct," and ordered them to attend ethics classes. He also ordered Attorney General Loretta Lynch to appoint someone from within the DOJ to insure compliance with his order. Good luck with that! AG Lynch has already indicated that her department will be ignoring this judge's orders; and why shouldn't she? She has the full backing of the President of the United States who has spent over seven years thumbing his nose at rule of law.

One of the hallmarks of a civilized nation is it's adherence to rule of law. This blatant disregard for rule of law by the highest office in the land is the kind of thing we see in third-world countries like Haiti and Venezuela. Sadly, it has become a hallmark of the Obama Administration. He's made it so commonplace that we've become numb to it. Add to this the Administration's editing of official records and recordings, the obstruction of congressional inquiries into the Benghazi massacre, the IRS scandal and Hillary Clinton's email fiasco, and you have a recipe for a Central American-style dictatorship.

Ethics classes? Why aren't these individuals facing prosecution and disbarment? Why isn't Loretta Lynch facing contempt of court charges? I'm no legal scholar, but these lawyers lied to a federal court judge in open court. This must fall somewhere under the High Crimes and Misdemeanors section of the US Constitution. The United States Department of Justice is the highest legal agency in our nation. These attorneys are "Officers of the Court." As such, they are duty bound to promote justice and the effective operation of the judicial system. Instead, they're subverting justice and impeding the judicial system. They must be stopped and held accountable for their malfeasance. To do otherwise would be to help this administration put one more nail in the coffin of what was once the greatest nation on Earth.

I have the same question.

It seems as though a jail term for contempt would be appropriate for the ones who lied to the judge and the ethics class for the rest of the entire legal department would be appropriate.

‘”In fact, it is hard to imagine a more serious, more calculated plan of unethical conduct.”’

Congratulations Justice Hanen - you have discovered the motto of the entire obama administration.

The rule of law in Obama’s America has become just rule. He does whatever he wants. The ‘GOP controlled’ congress does nothing to stop him, and in fact, enables him.

If the Democrats controlled congress they would NEVER allow a sitting Republican president to get away with such a reckless abuse of power.

The rule of law in the Obama Administration consists of the laws he ignores and the ones he makes up.

For the last 7½ years there has been a dual system of laws.

First, we have the constitutional laws.
These are the laws on the books created by the legislature in accordance with the US Constitution.

And then we have the unconstitutional King Obama’s Law.

The laws on the books can be read and discussed but have effectively been relegated to history by dictates from King Obama.

However, as soon as a republican is elected president, democrats will once again demand that the president strictly adhere to Constitutional law.

Another question:

If the president (Clinton) could and did lose his license to practice law for lying in court, what is the reason for these lawyers who lied looking the judge in the face not being permanently disbarred?

A lawyer lying to the judge is so much worse. It completely destroys the effectiveness of the court which relies on the ethics of the lawyers.

A defendant, as in Clinton’s case, can get some sympathy for lying to save his hide, but there is no excuse for a lying lawyer.

Exactly right, but don't forget the role of the press in ignoring Obama's abuse of power. Imagine if a Republican president sold M-16s to Mexican drug lords.

There’s going to one day soon be a NEW “rule of law” enacted by We The People of the United States, and it involves two very basic concepts:

1.) Which members of the Obama regime have violated our Constitution, ignored our laws, and committed acts of treason?

2.) How many light poles are there in Washington, and how much piano wire can be trucked in on short notice?

My last and ultimate test for the “rule of law” in America is whether Hillary and Bill Clinton will be held to account for their lawlessness.

If Hillary’s allowed to get by without facing charges, the rule of law is dead in America. There is no way our country can survive as a free nation when oligarchs are allowed to break the law with impunity and hammer ordinary working folks for the smallest of infractions.

Hillary MUST BE indicted for the rule of law to have integrity.

Exactly right. The media is the Left’s ally. Although their credibility has been severely damaged in recent years, they are still an effective propaganda machine and a useful tool of the Left.

Trump should expose the media’s machinations at every opportunity. Pound away and never let up.

...just like his sub-Saharan dictator cousins that took over the former functioning solvent African republics and used the law as a weapon against their political enemies...

...lawfare = ‘civilized’ warfare.

There is no law with this uncivilized wild bunch.

The judge stopped his SECOND illegal amnesty for illegal aliens, DAPA.

Our worthless opposition party refused to take him to court to stop his first illegal amnesty for illegal aliens, DACA.

The first illegal amnesty for illegal aliens continues unabated.
In fact, our House of Representatives just voted to extend the ability to join the military to illegal aliens amnestied under the first illegal amnesty for illegal aliens, DACA.

Sadly, we cannot blame this solely on Obama and the Dems. The GOP has been willing enablers/co-conpsirators.

The GOP controlled House (meaning leadership) would rather file a lawsuit (pay lawyers to do their dirty work) than exercise the most powerful tool available. The power of the purse.

Boehner said it best, [paraphrased] once inside the beltway, he realized he couldn't fight them, so he joined them.

It has been demonstrated over and over and over that the House lacks the raw political power to control the purse.

The Senate will not allow House control over money

It’s gonna take a military intervention to remove the parasites (R and D). Either our own, or someone elses. Such is the way of tyrants.

He deserves to be treated that way. He would lock you and I up for doing that. Now he just stamps his feet, but there are no consequences. Why wouldn’t they keep doing it?
