Freddie Gray trial: expert witness crumbles in van driver's prosecution

Prosecutors seeking murder charges over Freddie Gray’s death rested their case against Caesar Goodson on Wednesday with an expert witness who crumbled under cross-examination. His testimony was the latest of several blows in the trial that experts say is prosecutors’ best shot at getting a conviction for Gray’s death.

After failing to win in the first two trials, the case against Caesar Goodson is especially important for Marilyn Mosby, the embattled state’s attorney.

Goodson was the driver of the van in which Gray was transported, and faces the most serious charge of second-degree depraved heart murder. Gray died of a spinal injury the medical examiner says he sustained in the van, prompting citywide protests.

Witness Stanford O’Neill Franklin, a former police commander, was called to support the prosecution’s theory that Gray suffered what is known as a “rough ride”, a practice in which a driver jolts and takes sharp turns, jostling a prisoner who is handcuffed and shackled without a seatbelt.

But when asked by defense attorney Matthew Fraling whether he saw any evidence of Goodson’s erratic driving, he couldn’t say.

Asked if, in reviewing footage of the van’s stops, he saw evidence of unexpected starts, stops, or turns, Franklin answered: “I did not.”

“It’s not your contention that Officer Goodson in any way engaged in a rough ride?” Fraling asked.

“I can’t say for sure,” Franklin responded.

I don't understand this case. The guy was some character known to the cops. He was arrested and cuffed for I think it is trying to run or selling dope. One or more of the cops put him in the van where he sat facing sideways. One or more of those cops should have fastened his seat belt. Either the van driver would have had to do something or the guy threw himself against the doors so hard that he paralyzed himself.

It was known that they gave prisoners a rough ride by some which is abhorrent to me. But it doesn't prove it was so in Gray's case. The driver probably knew where the cameras were.

So why wouldn't someone be liable for 2nd degree murder, negligence or some other charge?

The prosecutor failed to turn over exculpatory evidence (Brady material) in the form of a statement from another arrestee who said Freddy was hitting his head against the interior of the wagon. Sanctionable misconduct.

The prosecution then put on an “expert” witness who was completely destroyed. As they knew he would be.

The case was overcharged.

Because the best evidence at this point indicates that Mr. Gray was responsible for his own injuries.

It appears that Mr. Gray was banging his head against the walls of the van very hard, enough that the other prisoner in the van clearly heard it. The other prisoner also told the police in a recorded interview that the ride was smooth.

Apparently Mr. Gray was fine after the period in time during which he was seated, and he was uninjured when the police placed him on the floor.

Forensically, it seems that Mr. Gray may have stood up, and then fell, fatally injuring himself. It is very dangerous to stand up in a situation where you could fall over when handcuffed, since you are unable to use your arms to break a fall.

It was. It was denied this morning. Defense is now putting on its case. Prosecution is intermixing paranoid rants with its questions. Claiming the police officer witnesses are trying to torpedo their case.

That’s easy; it was black on black violence. The most serious charges were being faced by the black cops who should have done that (fastened the belt, etc.).

A black co-worker briefly did her hair like that Mosby token; I think other blacks told her black cops were facing charges, so it went back quickly.

freeandfreezing, thank you very much. That explains a lot. I went back and read the rest of the article, and some of it became more clear.

reagandemograt, yes I get it, failure to turn over evidence and it would be dangerous to fall in those circumstances and he was resonsible to his own injuries. It sounds like not being belted wasn't an issue.

Raycpa, no, definitely he wouldn't be guilty unless he was driving in a reckless manner. I've ridden a lot of busses and never experienced what I would call a bad or reckless driver. And I was lucky never to get thrown down or against something hard from a sudden stop.

Thank you, all, for clarifying for me. I hadn't kept up on this case. Burnout from Martin and Brown.

Perhaps she is a fool, if you look for honesty or integrity. She is a fool, if you are looking for the greater good of the U.S.

But, if she is looking for a finantial bonanza as one of the rock stars of the racial grievance money making machine, she is a genius. She might ride this right into the House or the Senate.

I did know it was a BFD racial issue and gathered Mosby wasn't well thought of, didn't know what to think.

Just hope there's no more rioting over it. And if the cops are really guilty, they ought to pay the price, and it is painful to watch them go down the tubes.

Apparently Freddie Gray was trying to hurt himself so that he could sue the city.

I've heard that the regulation that prisoners should be seat-belted had been adopted only 3 days before Freddie Gray's ride in the van, and the new rule had not been communicated to the cops yet.

Trying the cops for murder is ludicrous, but makes sense in political terms (to quiet the riots, and to advance Mosby's political career).
