Rep. Becerra: Congress Should Not Leave Without Voting on No Fly, No Buy

House Democratic Caucus Chair Xavier Becerra (D-Calif.) urged Congress on Wednesday not to leave for the week until it votes on a measure that would prevent people on the government’s no-fly list from purchasing a gun.

“This Congress should not leave this week without giving us a vote on something very simple: No Fly, No Buy. If you can’t fly, because you are on a watch list by our government and you are not allowed on an airplane, you should not be allowed to enter a gun shop and walk out with an assault weapon,” said Becerra.

The bill [1] Denying Firearms and Explosives to Dangerous Terrorists Act of 2015, also known as No Fly, No Buy was introduced [2] by Rep. Donald Norcross (D-N.J.), a member of the House Budget Committee, as an amendment to the Fiscal Year 2017 Budget.

It “Amends the federal criminal code to grant the Attorney General the authority to deny the transfer of firearms or the issuance of a federal firearms and explosives license to any individual if the Attorney General: (1) determines that such individual has been engaged in or has provided material support or resources for terrorist activities, and (2) has a reasonable belief that such individual may use a firearm or explosive in connection with terrorism.”

It also “allows any individual whose firearm or explosives license application has been denied to bring legal action challenging the denial.”

I have a personal interest in this hijacking or the no-fly list. If it becomes a criterion for gun purchases I am sure I, and everyone else on FR will be very quickly added to the list. The airline industry will suffer when the list gets bloated to maybe include what, 30%, 40%? of the population and we will have to do any overseas travel on ships like in the very old days..

Did he mean he was meeting with the NRA to discuss this issue. I’m not a tweet person so I don’t know. The only thing I saw was a meeting scheduled with the NRA. As we know, Trump sometimes isn’t clear on some things.

I agree with it. So you go purchase a gun and your name pops up. You can protest or walk out.

And if you're as innocent as a baby lamb, you should probably look into the list and get your name off.

Does Becerra think the Orlando shooter was on the No Fly list?
If so, how did Mateen get to KSA at least twice in the last few years without flying — was he a strong swimmer? Or is the list that ineffective?

Becerra seems to be exploiting a terrorist incident to curtail the rights of Americans, when his proposed remedy would have done nothing to stop it.

Apparently the assclown had a FL state license as an armed security guard so it’s obvious an extensive background check must have been done. Or not. Talked to by the fbi at least twice. Yeah Barnie. He’s good to go.

Becerra, the representative from Maryland, ... oops!!
The house his family lives in, and where his family members are registered to vote is in . . . that’s right, Maryland.
Not NBC, Stanford Law, no private sector experience, went straight into Goobermint, Dream Act, Open Borders, pro abortion . . .

Guess I disagree with everything this person stands for.

But criminal illegal aliens get their full due process rights and the Justice Dept makes the FBI close terrorist investigations if no arrest can be made, so at least these two groups won’t appear on any such no buy list.

That would be my amendment - put in a requirement that getting added to the no buy list can only be ordered by the deportation courts and each case must be kept in chronological order.

Illegals receive due process under the 14th and 5th amendments, receiving court dates that 90% blow-off.

But once again the left—here a Californian `rat—talks enthusiastically about flatly denying citizens their procedural due process rights, and the 2nd amendment takes it in the neck along with the guarantee to procedural due process.

Instead of a perfunctory infringement on the 2nd, why not let the feds do what they love to do: write those on the `no fly’ list and inform them they are entitled to hearing on the matter of buying firearms, like they do with the illegals?

Trump needs to exile the muslim immigrants and all illegal immigrants that are here just to preserve the American people's freedoms, liberty and security. Anything short of that is nothing but an attack on the real Americans.

The Republicans should offer a version that introduces Due Process rights to the No Fly List. If there is a valid process and due process rights behind the No Fly List, I would have no problem using it for NICS checks.

How much do you think bringing a lawsuit and proving your innocence will cost in money and time? My guess is $50,000 and several years at least. The time and resources required on the government side to investigate and adjudicate what would likely be thousands of challenges would swamp the judicial system (That’s a big reason why the no fly list is secret). What would prevent the government from putting you back on the list immediately after you won your case? Most people will not have the resources to fight it.

The proclaimed guilty until proven innocent concept violates the Constitutional rights of US citizens.

Exactly; until there is a procedure of due process in which the burden of evidence (and preferably cost as well) is on the government to prove their case, no citizen’s rights should be stripped away. Now if they want to ban immigrants from buying guns, I could care less.
