There's very little discussion of why she used a private server.

The most likely reason is that the the emails contained discussions--even negotiations--about her sale of State Department favors for contributions to the Clinton Foundation. This HAD to be done on private servers so they could be destroyed if sought by Congress or the DOJ.

In the US, it is difficult to prosecute a person without a security clearance for mishandling classified information.

The US doesn’t have an Official Secrets Act like the UK. Therefore, there is a very high burden to meet, because it is balanced by the First Amendment.

The person with a clearance essentially signs away that protection on the SF-312 when briefed.

Who is the highest official ever to serve time in jail in the U.S.? I’m guessing a governor (Blago of Illinois for one. A democrat governor or two from Maryland).

There were the various Nixon administration officials. The Atty General (John Mitchell) served 19 months.

Since Watergate, who was the highest official to serve time in jail for corruption?

Breaking rules is not the same as committing crimes. Much as I want her royal bitchiness to fail, if it’s not criminal, she skates.

We have rules in our house, mostly for our two kids. Nobody goes to jail for breaking them though. What Her Royal Thighness did, is breaking the law.

I have NO doubt that she 100% intended to squeeze every red cent out of her job as Secretary of State that she could manage. It was pay to play .... it had to be kept private. Catherine Herridge, one of the few true reporters out there, has stated that the FBI has recovered the “wiped” emails - I am sure the FBI has plenty to work with regarding “corruption” charges. In fact, I’m sort of wondering if the McAuliffe investigation didn’t either come about or get legs due to emails Hilly had tried to delete ... just a thought.

Kendall had a security clearance...

It doesn't matter that he had/has a security clearance. He needs two parts: 1) A security clearance commensurate with the information that he is handling, and 2) a need to know. He didn't have a need to know and therefore should not have been handling the information. He also needed to store the information somewhere that was also commensurate with the level of classification of the information. Did he do that? If not, then he should liable to mishandling classified info.

When I handled secret stuff back in the old days and I had treated it’s security with all of the seriousness as a “Do Not Remove Under Penalty Of Law” mattress tag like she did, I would probably now just be getting out of federal prison. I also wouldn’t even be allowed to go near a classified ad. I guess it’s good to be king.

“Rules” in Federal documents become laws once they are enacted after a review period in which any citizen has standing and can suggest changes within the scope of the new Rule or Rule amendment.

Until the proposed Rule or Rule amendment is finally signed and appears in the Federal Record it is just a proposed Rule and not a law. According to the title and format of the Rules cited by these posts on FR, the are certainly Federal laws.

Clinton was not compliant with multiple laws and should go to jail!

By the way, none of her criminal activity can legally prevent her from becoming President if she is the choice of the people on election day.. She may have to be a president serving from jail, but so be it.

My point was merely about the knowledge he would have had about proper access/storage, etc. of/to classified information due to the fact that he either still had or had a security clearance of some sort due to being the attorney for Petraeus. You are pointing out the further implications regarding what actual clearance he had & as you noted, there are plenty.

Kendall received “special treatment” by the State Department when it was determined that the copies he was holding contained at least one classified record. Very unusual ... he was obviously getting the “kid gloves because it’s Hillary Clinton” treatment. Good article on this at the link - how State tried to accomodate him by providing a safe for his office, etc. Kendall should be in serious jeopardy of going to jail, but he’ll get a ride on Hilly’s coattails (as will Mills, Sullivan, Abedin, Kennedy, etc.) unless a miracle happens & DOJ goes after her along with her partners in crime.

Re: My post #32 above “Federal Record” should be “Federal Register”, which is publically available and on the web.

In short Clinton - and the State Department plus it’s overseers have broken the law. She is a criminal- whether intentionally or not, and should be convicted in a Federal court of law.

I could be mistaken but I thought is was Attorney General, John Mitchell, under President Nixon.
