Ted Cruz Is A 'Natural Born Citizen,' Board (Illinois) Of Election Finds

On the same day he won the Republican Iowa caucus, Sen. Ted Cruz of Texas got a favorable decision from the Illinois Board of Elections, which ruled that he met the citizenship criteria to appear on the state's primary ballot.

Two objectors, Lawrence Joyce and William Graham, had challenged Cruz's presidential bid with the board, contending that his name should not appear on the March 15 ballot because his candidacy did not comply with Article II of the Constitution.

In response to the filings, Cruz's lawyers relied on Supreme Court precedent, legal history and articles from noted constitutional scholars to defend the view that he is in fact "natural born" within the meaning in the Constitution.

And you ARE refusing the definition of "natural born citizen" CLEARLY DEFINED by our FOUNDING FATHERS !

In grammar school when they still taught American history and the US Constitution, my teacher explained to us that Congressman and Senators could be born in foreign countries but the POTUS had to be born in the US. His allegiance had to be to the US and only to the US.

Would you be as comfortable with Cruz if he were born in Yemen with a Muslim father and an American mother?

I am old enough to remember being taught in grade school government classes that you had to be born here to become president. I wish we still educated our young people in our schools. FYI, I was educated in the 50s and 60s,

There is no way in hell that the Son of a Cuban born in Canada to an American mother is a natural born citizen of the United States going by the original intent of the founders. In fact going by original intent Ted Cruz would not even be a citizen of the United States.

A baby being born entitled to a US passport is sufficient for the baby to be Natural Born.

The process of actually obtaining the passport is a mere formality. The baby is natural born because of the circumstances of his birth, not because of State Department paperwork certifying the objective fact.

They still taught that in 1970 and I agree with you. No way in hell would Cruz be allowed to run. I'm sure Trump remembers those lessons as well.

I know there are too many IFS in this question, but does anyone know, because I’m curious, IF Cruz (or Rubio) won the election to become President, and the day after the election or thereabouts, suit was brought claiming ineligibility, which could drag on past the January swearing in, who then would be the President? Would Obama get to stay in until a determination was made, and IF the suit was against Cruz (or Rubio), would the Presidency be awarded, eventually, to the runner up Republican with the highest votes. The worry is who would be President in the inerim? Cruz (or Rubio’s’) V.P. appointee? Or IF Cruz or Rubio was deemed illegal wouldn’t that exclude their choice for V.P. I would like to know what would be the possible scenario on something like this.

That is an interesting question. I’m not a lawyer or anything close to being a constitutional scholar, but I will offer this:

The Constitution clearly states that both the President and VP’s term of office are limited to four years, without any exception. Therefore, I would assume that no matter what happens to a President-elect, the former President and VP would still have to vacate their respective office. Even if the President-elect is involved in a court case that has NOT yet been decided by the time of noon on Inauguration Day, he would still likely be sworn into office (being innocent until proven guilty). But, if a case was decided making the voter’s pick ineligible before the President-elect is sworn in, the VP on the victorious ticket would likely be the one sworn into office. The voters after all pick BOTH the President and VP at election time, and I see nothing in the Constitution that would automatically disqualify the VP-elect if the President-elect cannot take office for any reason. And even if both the President-elect and VP-elect could for whatever reason not take the office of President, the Constitution clearly states that the current Speaker of The House of Representatives would be the next successor in line to take that office.

The Naturalization Act is a law passed in Congress. It is not binding on future congress' which have the authority to change laws. Other Congress have changed the "free white person" definition to allow non white persons to be admitted as citizens. In any case, naturalization is a process available to those not already deemed citizens at birth.

I'm confused on which side of the discussion you fall or perhaps you are confused on which side I fall.

I agree with this part of your post,
"The U.S. Constitution allows only a natural born American citizen to serve as president. Most legal scholars who have studied the question agree that includes an American born overseas to an American parent, such as Cruz."
