Video prompts calls for D.A. to reopen case of fatal shooting by L.A. sheriff's deputies

The video showed a life-and-death struggle between two Los Angeles County sheriff's deputies and 23-year-old Noel Aguilar on the driveway of an apartment complex in Long Beach.

As the deputies tried to clap handcuffs on Aguilar, who was resisting arrest and was believed to have a gun, one deputy shot at Aguilar but hit his partner instead.

Aguilar continued to wrestle with the deputies.

"I didn't shoot nobody," Aguilar insisted before both deputies shot him at point-blank range.

The case is the latest in a series nationwide in which a bystander's cellphone video captured the graphic details of authorities using lethal force against a suspect and raised questions about whether the force was justified.

Better video elsewhere, like The Independent, which I can't post.

Keeping in mind that the video was annotated and released by a lawyer for the Noel Aguilar's (the shot cyclist's) family, what I see is that:

1) a dark object is lying by the wheel of the car at the beginning of the video

2) at about 0:20 Off. Murade uses his night stick to beat Aguilar's hand. Then Murade picks up something small, which he tucks into the front of his pants

3) at 0:50 Aguilar heaves up on to his knees, and Off. Ruiz reaches for the dark object in front of the wheel, which is now apparent as a gun. He brings it forward into the struggle, and it is out of view.

In the struggle, Murade has Aguilar in a headlock. Aguilar's right hand is visible and empty behind Ruiz's back.

4) At 1:15, there is the sound of a shot. Murade cries out, Ruiz falls back with the gun in his right hand, recovers himself, and brings the gun back towards his waist.

It is possible that Aguilar got his left hand on the trigger, but Ruiz maintained his grip on the gun. Ruiz did not say, "Oh, s---, that was me," or "I have the gun."

The struggle continues.

One of the officers asks "Where is the gun?" Aguilar says "I didn't shoot nobody." "Why you pulling a gun on me?"

At 1:55 during the struggle, Ruiz shoots Aguilar in the stomach, and then Murade pulls his gun and shoots Aguilar three times in the torso.

I'm not seeing the gun planting part.

And granted, if Aguilar had been completely compliant, he probably wouldn't have been shot.

What color is Mr. Aguilar's skin?

That's the only thing that matters in these cases.

He shouldn’t have been resisting.

BUT

it’s obvious to me the one officer shot his partner, then they both executed the dude being held down.

Heck the one officer shot the guy 3 times in the back while he was being held down!

That’s murder.

My thoughts are their are no winners here. The deputy who shot the suspect 3x in the back, was probably in shock at that point after taking a round in the gut. It does not justify the shooting, but then again how is one supposed to act thinking the suspect just put a bullet through their gut.

From the audio it sounded as if this incident occurred in Mexico. Gangs organized by illegal aliens are endless in the region, and they recruit legals just as Muslims convert easy targets in the U.S. It's disgusting what D.C. and the CA government have done to once great state of CA. Do not let this happen to your states folks.

I can only hope at some point those responsible for this epic lawless invasion will be held responsible.

Mr Aguilar did nothing to deserve a death sentence but that is what he got. The cops lied about what happened until witnesses said that he never had a gun. When that came out the cops said that he reached for their gun and that is probably how the one cop got shot but that wasn't so and is clearly so from the video. This is a sickening murder or execution. I wish I hadn’t seen it, I'll likely never forget it and never have respect for an LA copy for as long as I live because of the actions of these two murders.

What difference does it make what color a mans skin is, murder is wrong and it is even worse when committed by those we pay to protect us. I hope these two murdering cops rot in prison for the rest of their lives and rot in Hell for eternity.

When you're actively resisting arrest like that guy was who knows what could happen.All I know *for sure* after seeing the video is that the guy was *actively* and *violently* resisting arrest and that several shots were fired.I don't see enough evidence to be sure who,if *anyone*,committed any crimes...except for the resisting.

If this case went to trial and I was a juror this video would only *prove* resisting to me.Therefore,the backgrounds and past history of all three involved would be of enormous interest to me.Psych history of all three.Criminal history of all three.Drug/alcohol history of all three.Disciplinary history of both cops.

Without things like that the only guilty vote I could cast would be guilty of resisting arrest.

Yes, it is, and look how quickly the cops and the DA tried to close this case as “a justified use of force!” This was a lethal coverup for one of the cop’s screwup shooting his partner. I hope they both go to jail for a very long time. Decent LEO’s should not worry about the public now having cameras, but the one’s who think they are above the law need to start considering that they may be being photographed at any time.

I watched this video.

My analysis...

The dark haired officer accidentally shot his partner while struggling. Dark haired officer loses balance and drops gun while catching himself. (You can see the gun in his hand and he picks it back up. Despite lawyers saying he tried to plant the gun this is not the case. (Appears to be a Glock 19 with a laser light combo on the front. Very common in California LEO agencies.) Bald cop is in shock after just being shot and thinks perp shot him. Bald cop, fearing perp has gun, pulls his weapon and shoots perp in the back to stop, what he believes, is a deadly threat.

The guilty party here is the dark haired deputy who was wrestling with his weapon and shot his partner.

Just my three cents. I will leave it up to the DA to prosecute.

Unless I see otherwise i would give the bald deputy, who was just shot, the benefit of the doubt. In that struggle all he knows is he got shot. He doesn’t know by who. In his mind the perp has a gun and just was just shot by him. He shot him 3 times in the back to end the threat.

That being said if the two conspired afterward to concoct a story OR his partner lied about the situation then there is a new level of conspiracy that must be prosecuted.

Just fire them both and pull their union cards. They’re not going to be prosecuted for killing him and they can’t be charged with stupidity.
