The government may start stripping passports from delinquent taxpayers. Can that really be done?

The Surface Transportation Reauthorization and Reform Act is likely about to become law. It has passed both the House and the Senate, and, while the conference committee could make changes, it's expected to pass on to President Obama largely intact. Buried in this massive bill is Section 32101, “Revocation or Denial of Passport in Case of Certain Unpaid Taxes,” which would grant the State Department authority to deny, revoke or limit the passports of any taxpayer certified by the IRS to owe more than $50,000 in seriously delinquent taxes.

Assuming the bill passes without veto, this will go into effect January 1, 2016.

This is not merely “late on your taxes” as the misleading headline implies. Save the breathless hysteria for DU and the MSM.

It means foreign nationals with passports who have ever paid income tax get to permanently stay if they chose to not now pay.

My point stands. Al Sharpton owes MILLIONS in unpaid taxes.....will he still be allowed to travel?

Get a clue. There are two sets of laws in this country and this only adds to that.

You failed to consider prosecutorial discretion

there will be no case against either Geitner nor Sharpton if the prosecutor decides not to bring charges.

the corollary to the prosecutorial discretion axiom is the IRS shall not investigate a case that will ultimately result in prosecutorial discretion

You’re right. Jurisdiction, once applied, IS NEVER expanded... Right? Not paying taxes is sometimes, not always, as a political activity. Remember the Boston Tea Party? Right to travel is associated with the right to assemble. The TSA is already considering requiring passports to fly out of the states that allow IDs for illegals. It’s very easy to see the day when you will be denied a seat on a plane because the IRS erroneously levied your business.

The is not an existential issue, and it doesn’t move us closer to a world without an IRS, so why defend it at all?

It has long been common practice in the US and elsewhere, that when someone is accused of a serious crime, they must “turn in their passport” until the legal process has worked its works.

The difference here, perhaps, is that instead of a potential criminal charge, the passport is taken away for a civil accusation, or to prevent “debt evasion” from the government.

This does need to be watched carefully, to insure that it *never* reaches into the domain of private debt. If it does, a debt collection agency might be able to say, “Mr. John Smith owes us $3,000, so we want his passport taken away until he pays us back.”

This is not far-fetched, because many debt collection agencies are using the courts for indirect debtors prisons. That is, they sue the debtor, but use minimal notification to the debtor of the court date, then when they do not show up, they ask the judge for a bench warrant for contempt of court, with bail set as the amount of the debt. So they are put in jail until either they or a relative coughs up the money.

This is yet another reason why it is a good idea to obtain a second passport. Not cheap, but what price would you put on your unrestricted freedom to travel?

You can travel legally under a second (foreign) passport, OR you could always try your chances crossing into Canada along our ill-defended northern border, or perhaps start paddling into the ocean from Florida.

How ironic would that be? Americans turning old cars into boats to escape our federal tyranny just like the Cubans used to do to escape Castro's Cuba?

Ha, yeah....good one. As you know of course, the protected, the connected, the offended, will not have any problems with the IRS. Only white conservatives.

BTW, any country that must "fence in" it's citizens - physically or financially - is NOT a great country.

...especially if those government employees happen to be among the hundreds of thousands of tax delinquent IRS employees.

As for illegal aliens....I don’t think they have US passports.
