Large Companies Game H-1B Visa Program, and Jobs Leave the U.S.

Théo Négri, a young software engineer from France, had come up with so many novel ideas at his job at an Internet start-up in San Francisco that the American entrepreneur who hired him wanted to keep him on.

So he helped Mr. Négri apply for a three-year work visa for foreign professionals with college degrees and specialized skills, mainly in technology and science. With his master’s degree from a French university and advanced computer abilities, Mr. Négri seemed to fit the bill.

But his application for the H-1B visa was denied, and he had to leave the United States. Back in France, Mr. Négri used his data skills to figure out why.

The answer was simple: Many of the visas are given out through a lottery, and a small number of giant global outsourcing companies had flooded the system with applications, significantly increasing their chances of success. While he had one application in last year’s lottery and lost, one of the outsourcing companies applied for at least 14,000. The companies were squeezing out American employers like his boss.

“I had this great American dream that got broken,” Mr. Négri said, speaking by telephone from Lyon, France.

Congress set up the H-1B program to help American companies hire foreigners with exceptional skills, to fill open jobs and to help their businesses grow. But the program has been failing many American employers who cannot get visas for foreigners with the special skills they need.

Instead, the outsourcing firms are increasingly dominating the program, federal records show. In recent years, they have obtained many thousands of the visas — which are limited to 85,000 a year — by learning to game the H-1B system without breaking the rules, researchers and lawyers said.

Another example of malicious government. Every government program is corrupt, run for the benefit of the cronies who have K St. lobbyists helping the Congressional committees write the rules to suit their donors.

Every one of these programs should be defunded and scrapped. They are doing nothing but hurting the American Middle Class workers who built this country and died in great numbers to defend it. This is the thanks we get.

Silly Frenchman, only H1B workers from india, china, and mexico get those visas. You europeans are too qualified and want too much money.

Apply again once the Soros/muslim overthrow of europe is finished, and the labor rates are brought down to slave labor levels. Then we’ll talk.

Abolish the quotas and insist that H-1Bs be paid at least 10% more than the going wage for the industry.

This is the way it is done in Japan. I was their equivalent of an H-1B worker for 14 years. This restriction not only ensures no game playing but limits foreign workers to the cream of the crop or, IOW, makes the employer tell the truth about why they need foreign workers-- they are only willing to pay them more if they are actually worth more.

The locals tend to welcome it also.

More foreign workers = a higher wage level for the industry = more attraction to the locals to get the necessary training to work there = a long-run lesser need for foreign workers.

If you do it first, you hurt your competitors.
If you wait for your competitors to do it, you’ll lose significant market share before you decide to copy them. If you don’t copy them you’ll be out of business.

The same logic applies to industries that hire illegal workers, companies that off-shore for cheaper labor, and H1B programs.

The only difference is that off-shoring is legal, gets tax benefits and currently has no repercussions. While hiring illegals and abusing the H1B programs are technically illegal and could have ramifications if only government would enforce the law.

TPA/TPP/H-1b/Illegals will be Trumps bludgeons against all others on the stage.

How to fix the economy? Fix corrupt trade deals, illegals sucking up good jobs that Americans would be happy to do.

And eliminate the H-1B and H-2B programs that are displacing 100s of thousands of American workers from good paying jobs.

Tariff every manufactured good imported from another country unless that country agrees to verified, totally open markets and floating currency.

Oh, the GOPe stalwarts will wax eloquently using the "protectionist" word often, citing Reagans advocacy for "Free Trade" etc.

But Americans have heard enough of that crap. They can see the results with their own eyes.

Or just give them an immigrant visa: at least then they can compete for higher wages instead of being indentured servants, although I don’t know why we need to import STEM workers when so many Americans with STEM degrees can’t find work.

It doesn't change the gist of the story but it's another bad headline. Technically, the jobs stay in the US but they're held by foreign nationals.
