Ok legal eagles, the SC can decline the case right? Then the 5th decision would stand.
Does the quick move to SC mean anything or just part of the process?

There is nothing in this to benefit the USA.
Maybe though Roberts was wrong he must have at least thought this could get Americans medical help (wrong).
Now for non Americans against what is good for the country you allow the President to just make law without the House and Senate?
Even with Obamacare there was a stupid law passed, not so with Amnesty for Illegals.

I will be surprised if the SCOTUS overturns the lower court's decision but then THAT'S PROBABLY WHY THEY AGREED TO TAKE THE CASE!!!

The issue is not changing immigration laws but rather whether the President can expand his ability to use prosecutorial discretion for individual cases to an entire class of lawbreakers. Going from one person to five million is a violation of the law. The President doesn’t have such powers as Obama himself admitted over 20 times.

He has no legal leg to stand on as “Separation of Powers” is fundamental to the Constitution.

Just goes to show the incredible commitment of the Obama administration to violate the laws as they apply to a segment of the population they want to favor, despite the fact that that segment is in the country illegally by definition.

But the appeal delays the ruling from the next highest tribunal, probably until after Obama leaves office when his executive order may not be enforced any more, God willing.

Please remember everyone that this is not over the substance of the suit filed by the states but rather the injunction stopping the federal government from doing whatever Obama orders while a court decides what he is doing is illegal and not harming the citizens of the plaintiff states and if he has that power. TWO courts have ruled the states have grounds to ask for relief from his tyranny. Now the Supreme Court will decide if they have grounds to review and reverse TWO courts who agree he doesn’t. Historically the court would say what is there to review? Two courts agree so there is no conflict for the Supremes to resolve. But with Roberts who knows. The lower court hasn’t even made a ruling over the main issues yet and really can’t because the Obama DOJ keeps on lying in their court filings.——a summation posting courtesy of ‘boutis’

Don't think they've agreed to hear the case yet.

The states should ask for the appointment of an interim DHS administrator reporting to the courts whose term expires when the next Presidential appointee takes office: after all, the enviro-kooks have gotten this done repeatedly with the Interior Department, so I don't know why they can't get it done here, and the only appropriate response to a faithless executive is to remove his direction.
