California Governor Denies Terminally Ill Access to Potentially Life-Saving Drugs

Californians who are terminally ill will not be able to access drugs with the potential to save or prolong their lives as a result of Gov. Jerry Brown’s veto of the Right to Try Act on Sunday.

AB 159, the California Right to Try Act, passed the state assembly and senate with overwhelming bipartisan support.

“It’s disappointing that Governor Brown couldn’t see the need to allow Californians the right to fight to save their own lives,” said Assemblyman Ian Calderon (D., Whittier), who sponsored the legislation. “Both Democrats and Republicans wanted this for our California’s terminally ill.”

In his veto message Brown wrote that “Patients with life-threatening conditions should be able to try experimental drugs, and the U.S. Food and Drug Administration’s compassion use program allows this to happen.”

“Before authorizing an alternative state pathway, we should give this federal expedited process a chance to work,” Brown wrote.

However, the expedited process by the FDA has not yet been put in place.

“Time is the one thing our terminally ill don’t have,” said Calderon. “I wish he would have given terminally ill Californians the hope of having more time to spend with their families by allowing them expedited access to potentially life-saving drugs.”

Brown’s veto of the act was a disappointment to many, including one firefighter suffering from ALS, commonly known as Lou Gehrig’s disease.

“I am very disappointed in Governor Brown’s devastating veto of The Right to Try bill. This allows the FDA to retain control over my ability to save my own life while I still have time,” said Mike DeBartoli, a former Sacramento firefighter suffering from ALS.

He supports abortions, allowing millions of people to be denied their lives, and now he denies people access to possible cures that might enable them to keep their lives. Seems that “death to people” has replaced “power to the people” in Democratic policy? Ps: I’m not unaware of difficult or complex issues and am prepared to respect some differences in judgment but there really seems to be an overriding anti-people theme in some politics these last five or six or more years? Is this a reflection, part of the anti- Christian attitude coming down from Obama team, or what?

I suppose we gave up God given Rights when we gave up God!

I’m not sure where to draw the line on this FDA issue with respect to Congress’s interstate Commerce Clause powers (1.3.1). But since the FDA’s main mission is evidently defined as promoting public health, it would appear that the FDA’s mission is in conflict with the Supreme Court’s clarification that the states have never delegated to Congress, expressly via the Constituton, the specific power to regulate intrastate health issues, not that the fed’s doing so with a proper amendment to the Constitution by state ratification is a bad idea.
”State inspection laws, health laws, and laws for regulating the internal commerce of a State, and those which respect turnpike roads, ferries, &c. are not within the power granted to Congress [emphases added].” —Gibbons v. Ogden, 1824.

The corrupt, post-17th Amendment ratification Senate should have done the right thing by leading Congress to successfully propose an appropriate health amendment to the Constitution before they helped to past legislation wihch established and funded the FDA imo.

In fact here’s what Thomas Jefferson had to say about the Senate helping the feds to overstep its constitutionally limited powers versus amending the Constitution.

"In every event, I would rather construe so narrowly as to oblige the nation to amend, and thus declare what powers they would agree to yield, than too broadly, and indeed, so broadly as to enable the executive and the Senate to do things which the Constitution forbids." --Thomas Jefferson: The Anas, 1793.

as with many primitive cultures in history, those in charge seeking such atonement are using innocent subjects as their sacrificial lambs

I say, let them jump right on the funeral pyre themselves if they really believe atonement is so necessary. Certainly the ‘gods’ would appreciate the ‘much, much more valuable sacrifices’ of our “ruling elite” rather than just the worthless bodies of us untermensch

PS: all this ‘leading from behind’ is wrong. very unfair to the rest of us.

The Veteran Affairs Administration in California and Nevada, is already doing, exactly the same deal. Except, it is not just the terminally ill. The elder treatable, are being dealt out of reasonable preventive care after age 60. The VA care from the goddamn 70’s is back. Stronger than ever.

Yes but too many Indians got killed before the Chiefs got their due What if someone were to erect a nice appropriately- luxurious sacrificial altar in wash DC just for the ruling elite to go see their “gods” as fast as possible? If they are so blessed, the rest of us would be left alone to complete our supposedly- drab useless meaningless sub- human lives down here on earth. Just a wild thought. Who in the h*ll does he “think” he is???? Does he not take an OATH to uphold our Natural Rights from GOD——and HE is NOT God........so why do the stupid people in CA allow him to violate his oath?

There is a NATURAL RIGHT TO LIFE which is unalienable.

CA needs to wake up and take back their state from the Marxist——we have Rule of Law-—not Rule of man in this country.
