Bystander Opens Fire on Shoplifter at Michigan Home Depot

A concealed-carry license holder is cooperating with police after she opened fire on a shoplifter who was fleeing a Home Depot on Tuesday afternoon, police in Auburn Hills, Mich., said.

The shooting happened in the store’s parking lot about 2 p.m., when Home Depot security was chasing a shoplifter in his 40s who jumped into a waiting dark SUV, said Lt. Jill McDonnell, an Auburn Hills police spokeswoman.

But when the SUV began to pull away, a 48-year-old woman suddenly began firing shots at the fleeing vehicle. The vehicle escaped – but possibly has a flat tire, McDonnell said.

The woman who fired the shots has a license to carry a firearm and is cooperating with police.

Cowlitz County Prosecutor Sue Baur said she will not prosecute a Kelso man who shot an arrow into the buttock of a suspected fleeing burglar late last year, but insisted Friday she is not encouraging vigilante justice....

“If someone chooses to use force on a fleeing felon, their facts better be right - and the likelihood of that is very rare,” Baur said. “So you take your chances, and that’s why we want you to leave it up to the police...”

Scott Allen Schwingdorf, 33, heard glass breaking at his neighbors’ vacant home...and spotted Galen Louis Crayne of Longview walking away from the residence with a brown box tucked under his arm.

Schwingdorf, who had armed himself with a hunting bow, shot a fleeing Crayne in the left buttock with a broadhead arrow, police said....

In a carefully worded statement released late Thursday, Baur said Washington State law allows citizens to “use reasonable force to defend property they own or have been entrusted with.”

(That “entrusted” with isn’t in the law. It is lawful anywhere that the person is allowed to be, and in defense of anyone or their property.)

Homicide is also justifiable when committed either:

(1) ; or

(2) In the actual resistance of an attempt to commit a felony upon the slayer, in his or her presence, or upon or in a dwelling, or other place of abode, in which he or she is.

Just as a clarification:

Does that mean shooting someone going 32 mph in a school zone?

Or shooting a five year old sneaking a candy bar at the neighborhood pharmacy?

Or blasting a 20 year old that is buying beer on a fake ID?

Or gunning down the person that is selling the beer?

You going to shoot ‘em all? And then ask them?

It used to be we would applaud a person for being helpful in trying to stop a criminal - man, we have lost a whole lot more than just freedoms!

Used to be we frowned on people setting out to kill someone without any reason.

Interesting....

Few years ago near me a young lady was car jacked at a gas station by an Obama son and forced to move to the passenger seat. CCW Permit Holder saw the whole thing and followed. The woman’s car was T-Boned by a garbage truck and she was instantly killed. Said Obama son got out and started running. Permit Holder followed and shot him DRT.

No charges....

His life wasn’t in danger either. Based on half the cowardly responses on this thread, I’d say most have been reprogrammed to just shrug off violence and let ‘The Authorities’ handle it. No wonder libs are winning!

As one with a CWP, the ROE in ND would allow me to shoot an Afghani policemen butt-raping some village boy (unlike the ROE the US Military operates under over there), but they won't let me shoot someone for shoplifting. The standard is to prevent 'serious injury or death', not to prevent property crime, nor to detain a fleeing suspect in a property crime.

I am not shooting someone because they shoplifted from Home Depot. If the vehicle presented harm to humans then shooting at it may have been ok. Can't tell from the OP what the circumstances were. Oh and I have been in two civilian gun fights. The best gunfight is the one you are not at.

Unloading on a fleeing shoplifters automobile! She’s seen too many movies. Now she will be paying out thousands to lawyers. So both Home Depot and she will take a loss.
A real shame she got so caught up in the drama.

Keep in mind that Home Depot has a history of falsely accusing people of shoplifting then “allowing” them to buy their way out of the charges. Story on this a while back (can’t remember which outlet) from California.

The fact is that this guy wasnt presenting a threat to her, and not having observed the crime she wasn’t in a position to know what had happened. All she had were the actions being engaged in by store security.

Which isn’t enough to justify use of lethal force.

Unless the driver of the SUV tried to run someone down or was firing at someone, not wise. Urge to stop the human filth was strong, but it was not the CC holder’s responsibility to stop the perp.

It isn’t that conservatives have been “retrained”.

It is that the responsibility for owning and carrying a deadly firearm includes being able to discriminate on when to use it.

It isn’t appropriate to shoot someone because they are shoplifting, that isn’t even open to discussion.

It is disturbing to me that your post had to even be written.

If we assume that it is indeed true that all that happened was that she shot at a fleeing shoplifter in a vehicle that did not appear to threaten to run her or anyone else down, etc., then what she did was so blatantly wrong she should not be carrying a weapon.

The fact that you had to spell that out to people who seem to be unable to face that reality is problematic.

Concur.

Suppose I happened to pull into that parking lot right at the time this woman is squeezing off rounds in the parking lot. I then decide that she is a threat to me and everyone else in the area and run her over or empty my weapon in her direction. I like my chances in court over hers.

Right. I could see someone asking the question “Why would you approve of a shop owner shooting a looter, but disapprove of someone shooting a shoplifter?” and that could be answered that looting is not the same as shoplifting.

But that would at least be addressing someone who is trying to think it through...not this silliness.

Stupid, stupid, stupid. She was not in danger and wouldn’t know where her rounds would be going. People like her make it bad for responsible gun owners. My PPD is for my safety and to protect me.

shoplifter can turn this around and say they were fleeing for fear of her and she will be charged with attempted murder or asset with a firearm or whatever
