I don’t know what the best or whole answer is, but we could start by expelling all muslims. I don’t consider islam a religion. They are taught to hate infidels and Jews and to do horrible things to us. There are no moderate muslims.

Not a lawyer either, but supposedly she would be fine with issuing licenses as long as her name wasn’t on them, as that fulfills her religious objection. Which makes me think she and her lawyer don’t buy the ‘gay marriage is illegal/all marriages are now prohibited since the SC ruled’ type arguments.

These authors at “Townhall” seemed to have slept in and missed the bus this morning. This isn’t rocket science. She was following the Kentucky law. What is so hard about that?

Except there is no “shall issue” law for marriage licenses on the books in Kentucky yet.

Let the legislature decide so that actual laws exist.

The correct defendant appears to be the State of TN, whose legislature should be ordered to make a law that complies with the SC decision, not some lowly clerk.

Bingo. Too bad so many legislative bodies seem to have the backbone of a fish stick.

And yet we do not assail the very use of the doctrine of separation of Church and State which is quoted as justification for all manner of ills but is not in any law or legal document.

Even Barr assumes its validity as a LEGAL doctrine. Davis was jailed for refusing a judge’s ORDER not for a violation of any law.

She is NOT imposing her religion on others any more than they are imposing theirs on her.

The government simply needs to be out of the marriage business. The ONLY reason for it is to support the myriad laws written around it. Wipe them away and we are done with it all together.

Marriage status then becomes NYB...Not your business.

And perhaps those who find a government for which they work so morally repugnant as does Kim Davis, would better serve the public they have sworn to serve, from outside rather than inside.

 

More stupid drivel.

Why not argue that religious tests should be applied to all government employees and deny Christians from getting a job? Why stop there? Apply this standard to ALL employees and just jail those dissidents who cling to their hate groups (religions)?

Even if it had been legally legislated it still wouldn't dictate that Day be forced to violate her religious beliefs. We've got a long history of conscientious objection in this country that doesn't result in loss of livelihood and certainly not in jail.

Even a single juror on a jury can refuse to convict an obviously guilty man for any reason or no reason and its completely unreviewable.

OHN ADAMS (1771): It's not only ....(the juror's) right, but his duty, in that case, to find the verdict according to his own best understanding, judgement, and conscience, though in direct opposition to the direction of the court.

It is my understanding that it is a felony in TN to issue a same-sex marriage license. So essentially, the federal judge is demanding she commit a felony.

I don't think you're correct in that. There was a law that said marriage licenses were not to be issued for same sex marriages but I don't think there was a criminal penalty attached to that.

I agree. This is going to become a battle won, and a presidential campaign WAR lost. I was sorry to see Cruz anywhere near Huckabee.

This case is a legislative matter that Congress must address, wherein courts are legislating and Congress folds.
THAT is the problem. Street fighting during our primary is a killer because it is so off the mark.

I mean if ISIS is here or on the way, we fail to muster for practicing our self righteousness in public.

Forget that. Just nullify the SCOTUS ruling and continue to issue male-female marriage licenses only. How many divisions does John Roberts have?

BTW, it's Kentucky...

Bob Barr can go back to Liberalville. I am a Christian and duty to my Lord Jesus and his Father stands ABOVE any other obligation, even if that means I am jailed or even killed by civil authorities. Apparently, Kim Davis shares this belief. Millions more Americans do, too.
