An illegal decree? How do you figure?
Kentucky has laws on the books defining marriage as between a man and a woman.
SCOTUS cannot pass laws only interpret so their decree recently on marriage is illegal because there is no Federal law on the books. SCOTUS cannot tell the States what they can or cannot do in this matter.
Until Kentucky convenes a session of lawmakers and either shoots down SCOTUS’s ruling or changes it’s law and accepts the ruling she has to follow Kentucky law.
The Federal Judge that has had her arrested has done so in violation of Kentucky law and is following Federal laws. It is the duty of the Kentucky Governor to stand up for Kim Davis in this matter but he has not done so.
There has been many conversations about this by scholars and lawyers. I am neither but I think I summed it up correctly.
