How can she be held in contempt when the Kentucky statute has not been struck down by the Federal courts or removed by the legislature?

She would have to be - otherwise - why would you wait to get ‘married’ so you can have that particular clerk sign the certificate?

Actually it was struck down by the SCOTUS...therefore we have no enforceable laws in which certificates can be issued. They are supposedly “unconstitutional.” Therefore until the legislature passes new laws, we have no valid law. She isn’t issuing licenses to anyone.

The fascist left has issued their commands. The question is how many decent people will stand up to them. I will applaud this woman, pray for her, and when the time comes send money to support her expenses. I hope millions of others will do the same - and will also stand in opposition to these shockingly unconstitutional orders from black-robed thugs.

Bunning is ordering a state official to do state actions. that is not within the jurisdiction of the Federal court - they should have had to file this in state court. Yet, he’s issuing orders anyway. He doesn’t understand something this basic.

And to think I remember us on a thread defending this judge’s confirmation during the hearings.

It was struck down by the federal courts as unconstitutional.

I assume that was invalidated by the SC ruling.

From my reading of the SCOTUS ruling, they did nothing more than affirm that any legal action done in one State must be accepted by all other States, validating reciprocity. Although I have not read the entire ruling, this appears to be an over reach by the Supreme Court.

Just as I suspect with the marshals that took Ms Davis away, I wouldn’t be surprised if the deputy clerks don’t know anything about the 10th Amendment or the personal protections of Section 1 of the 14th Amendment.
