Look at it this way. Lets take ALL the religious aspects of this matter off the table. Leave her moral convictions alone for a moment.

Was the SCOTUS correct in their ruling?

Was Mrs. Davis correct in following Kentucky law?

So WHY are you kicking her to the curb?


And that line of reasoning is what Christians SHOULD have done with the equally wrong/reprehensible Roe V. Wade - we should have fought tooth and nail to preserve our states rights to make the law on that issue. Instead, we were cowards and just let the Supreme Court essentially make State law and illegally take on a power they didn’t have. So now we continue down this horrible slope started way back in 1973.

All good questions. As to couples who were shacking up, from my own family experience, would you or God for that matter prefer that these folks not get married? Same and even especially if the woman is pregnant? I am a retired and recovering divorce lawyer so I’m probably not a good person to answer the third question. I’m also Catholic and decided a couple of years ago not to file any more divorces. I don’t think that she has been issuing any licenses. I guess I’m curious as to what she is in contempt of. Indirect civil contempt is a tricky thing. I’ll be watching this closely.

Did G*d prohibit concealed carry? Did G*d prohibit drinking alcohol? The bible expressly prohibits male homosexual sex. The Bible defines marriage (a religious sacrament) as between one man and one woman. The Supreme Court is insane if it thinks it can over turn 5,000+ years of tradition without major push back.

Who's authority over us is given by the consent of the governed. The "governed" did not consent to this.

I've been perusing Kentucky law on the subject for the past several minutes. A few things pop up:

> 402.240 County judge/executive to issue license in absence of clerk.
In the absence of the county clerk, or during a vacancy in the office, the county judge/executive may issue the license and, in so doing, he shall perform the duties and incur all the responsibilities of the clerk. ...

> 402.080 Marriage license required Who may issue.
No marriage shall be solemnized without a license therefor. The license shall be issued by the clerk of the county in which the female resides at the time, unless the female is eighteen (18) years of age or over or a widow, and the license is issued on her application in person or by writing signed by her, in which case it may be issued by any county clerk.

Point 1: There is no provision in State Law for a deputy clerk to issue licenses. Also: it's a "may issue" clause - not a "shall issue". Same language exists on the title of 402.080 with regard to clerks.

Point 2: Only lesbian couples can legally satisfy the requirements of the application form (requiring a female in residence of the state/county)... never mind the other state-defined prohibitions to marriage among same-sex couples, of course.

It's not clear whether they were ordered or volunteered to join in her refusal. That can be a hard call. The deputies are due in court in about 15 minutes with public defenders, and could face fines or jail.

And sometimes putting them into a position where they can’t do anything at all is the best option.

Like I said earlier, Matt Bevins will most likely be the next governor due to this. And he’ll probably have a solidly-Republican State House of Reps due to it too.

It is not her job to issue marriage certificates for faggot nut jobs any more than it is "her job" to issue marriage certificates to horses, dogs, bugs or plants.
