Rowan County Clerk Kim Davis denies marriage license for gay couple for third time

Rowan County Clerk Kim Davis continued to withhold marriage licenses from local residents on Thursday, a day after a federal appeals court upheld an order telling her to end her protest.

James Yates and William Smith Jr. were turned away by a deputy clerk in Davis' office Thursday morning when they asked for a marriage license. The deputy told the men Davis believes she can legally withhold marriage licenses until Aug. 31, next Monday, under an order issued earlier this month by U.S. District Judge David Bunning.

Davis has refused to issue any marriage licenses since the U.S. Supreme Court legalized gay marriage June 26. Thursday was the third time Yates and Smith had requested a marriage license from her office, and they were visibly upset.

"Justice delayed is justice denied," Smith said after they exited the courthouse.

"We should be celebrating right now, enjoying our lives together," Smith said. "Instead, we're on nerves, waiting for someone to say we can get a marriage license."

Davis remained behind a closed door inside her personal office and declined to appear or comment.

On Wednesday, the 6th Circuit U.S. Court of Appeals denied Davis' request to stay a preliminary injunction from Bunning ordering her to resume issuing marriage licenses, despite her religious opposition to same-sex marriage. But there is some confusion as to whether Davis was in contempt Thursday, because Bunning did agree to temporarily delay his injunction until Aug. 31, to give her time to appeal.

I don't see this as any different than Muslim employees who refuse to sell pork or alcohol - do your job, like it or not.

You work for a court, you represent the court, not yourself.

I just can't sleep or enjoy myself ... not even being alive ... unless I get a piece of paper signed by the government

How about slavery? Slavery was once legal.

What about Women's suffrage? Women were legally denied the right to vote.

Civil Rights?

Point is: an immoral law must be resisted. Marin Luther King knew it. Jesus Christ knew it.

The court is suppose to uphold the Constitution. They are not allowed to make law or twist existing amendments. The framers did not list or mention marriage as an inalienable right in the Constitution. It is not there. Marriage obviously was practiced, acknowledged, and accepted, yet not added. An amendment would have to be added to the Constitution which would be absurd. The founding of this Republic was not based on sexual habits and proclivities. The states did have laws regulating marriage and discouraging promiscuity. The states are sovereign and did so. The problem now is Americans are drunk with sex and want it any way they wish without the life long commitment of marriage, children, and STD’s. Sorry this ain’t Burger King. You can’t just have it your way without consequences.

Any delays that they experience, after the first turndown, are at the their hands too.

I mean, when I encounter an obstinate government employee (for a service I can obtain at more than branch), the first thing that I do is find a lawyer and file a lawsuit.

Yeah, I get it. But, like it or not, clerks of courts do not get to override the U.S. Supreme Court.

And that was not the first bad decision or twisting of the Bill of Rights or Constitution - SCOTUS has been getting it wrong on free speech, the Fourth Amendment, property rights, abortion, etc for decades.

Unfortunately, we live in an age where everyone thinks they are a special little butterfly & the world is all about them. This person has a job to do. If they want to protest, quit their job.

Let me put it this way - should a government official have the power, on their own, to deny someone a CCW license because they don't like the Second Amendment? Because that's the kind of thing you're advocating for.

Yeah, iirc there have been articles about them specifically targeting her.

If they are in such a hurry, and speed is their main motivator, there are other places for them to get a license and get married. Like Vegas.
