Trump: I'll rescind birthright citizenship

Donald Trump plans to undo President Obama's executive orders on immigration, get rid of birthright citizenship, and deport all undocumented immigrants if he is elected president, he said Sunday.

Birthright citizenship "remains the biggest magnet for illegal immigration," Trump said in his 6-page immigration policy report titled "Immigration Reform That Will Make America Great Again."

Speaking to NBC's Chuck Todd aboard his gilded private plane on "Meet the Press" Sunday, Trump said of the current illegal immigrants in the country, "We're going to keep the families together, but they have to go."

When Todd questioned where they would go if they have nowhere to return to, Trump repeated, "We will work with them. They have to go. Chuck, we either have a country, or we don't have a country."

Trump said that Sen. Jeff Sessions, R-Ala., helped him come up with specific policies on immigration, and that he will streamline the process for becoming a legal citizen. He plans to triple the number of Immigration and Customs Enforcement officers, require companies to hire American workers first and mandate nationwide e-certify usage, among other measures.

"Before any new green cards are issued to foreign workers abroad, there will be a pause where employers will have to hire from the domestic pool of unemployed immigrant and native workers," the report outlines.

In the report, Trump reiterates that he will make Mexico pay for the wall. He plans to do this by impounding "remittance payments derived from illegal wages," increasing "fees on all temporary visas issued to Mexican CEOs and diplomats" and fees on border crossing cards, North American Free Trade Agreement worker visas from Mexico and fees at ports of entry to the United States from Mexico.

"We will not be taken advantage of anymore," Trump said.

Obama's executive order that protects illegal immigrants' children, called Dreamers, from deportation, "we have to" rescind, Trump told Todd on Sunday.

"We have to make a whole new set of standards and when people come in, they have to come in legally," he said.

Trump said he will fix the immigration system so that illegal immigrants who work could quickly return — legally.

And it’s also possible that law could be amended.

The Constitution can be amended but the President has no role in that process. 2/3 of both the Senate and House propose the amendment and 3/4 of the states must ratify it. You can't just pass a law negating the constitution.

No I mean governing statute, ahead of any court challenge. Just put these people in the same category as children of ambassadors, with the same rationale.

That's exactly the point of the "subject to the jurisdiction" language. Foreign diplomats aren't fully subject to our laws. That's what diplomatic immunity is all about.

Ilegal aliens are.

I think we are the only country left that allows birthright citizenship ie anchor babies and we need to get rid of it.

Canada and Mexico have it, as do most of the countries in Central and South America.

There are lots of people who are born in the US who are not citizens - the children of ambassadors for example.

The children of ambassadors born in the US are pretty much the universe. How many can you name?

Children of foreign invaders would also qualify. How many of those can you name? (It's wise to kill foreign invaders before they can reproduce.)

Ambassadors don't have to pay their parking tickets. They are not "subject to the jurisdiction". The rest are, and their offspring born here are therefore citizens. Until the Constitution is changed.

are persons who cross the border and enter the country illegally “subject to the jurisdiction?”

A test is whether such persons are legally obliged to pay their parking tickets. If the answer is yes, then they are "subject to the jurisdiction." Unless, being members of an invading army, they are able to reject such obligation through force of arms.

That means pretty much all ilegales are subject to the jurisdiction and thus able to spawn and drop anchor babies.

It takes an amendment.

I suppose congress could pass a bill that defines
what the phrase “subject to the jurisdiction thereof” means.

Back in 1897, a bill to define PI as 3.2 came before the Indiana legislature.

It didn't pass. But if it had, it would not have changed PI.

Nor can today's Congress redefine "subject to the jurisdiction" as it was used in the 14th.

Seems to me the only change needed is to say that at least one parent has to be a citizen for the child to be a citizen.

I suppose if at least one parent is a legal resident on some kind of temporary visa, the child would have to inherit that residency on the same timeline.

A lot of the stuff Trump wants to do will require legislators to agree to it. So he could make an amendment a part of the package he pushes for on the bully pulpit.

Better finally get anti-abortion and man-woman-marriage amendments on the table while we’re at it.

And if one parent is on the legal path to citizenship, then their child should be able to get it at the same time they do if they were born here.
