Gowdy: Hillary Clinton Should Be Treated As David Petreaus Was, Equal Under The Law

As you've probably read by now, Democratic presidential candidate and former Secretary of State Hillary Clinton had at least two top-secret, classified information emails stored on her private server. The FBI is currently conducting a criminal investigation and her server has been turned over.

The Clintons have always been known as the teflon couple, somehow capable of dodging any scandal that comes their way. But this time, things could be different.

As you'll recall, General David Petraeus was charged, prosecuted of convicted of improperly storing classified information in his home. The information Petraeus had was categorized at the lowest level of the classified tier. The information found on Clinton's server by the Inspector General is classified as top secret, the second to highest level.

So the question is now, will Hillary Clinton be treated equally under the law? Or will she get a free pass? Chairman of the House Benghazi Select Committee and former prosecutor Trey Gowdy believes in the former.

"The lady out in front of the Department of Justice wears a blindfold and holds a set of scales and she does so that she treats everybody the same whether it's me or you, whether it's General Petreaus, whether it's a cabinet level official. I was not part of the prosecution team or the defense team for David Petreaus, I don't know all of the facts. I know this, the same rule ought to apply people irrespective of their station in life," Gowdy said during an interview with Fox News Wednesday. "So, I'm going to have to count on the Bureau [FBI] and [Director] Jim Comey has a reputation for even handedness and fairness. The same folks who investigated and prosecuted General Petreaus are looking into the current allegations with respect to classified information and if the facts are the same then I expect the result to be the same."

We'll see if Lady Justice is really blind.

I spent 4 years working in Washington at the end of the Bush 41 and the beginning of the Clinton administrations. At that time there was a cadre of long time federal employees in the various departments that remained from administration to administration that believed the appointed officials were temporary and only needed to be tolerated. They tended to take the rules very seriously and came down hard on appointees that broke them. Those at the higher levels of the permanent bureaucracy relished taking down appointees.
Hopefully, they still inhabit the FBI.

The first video has Trey Gowdy at the beginning and Judge Nap follows.
the second video is Judge Nap on Fox and Friends where he clearly outlines the 3 levels of information from confidential to secret to top secret.

There is a thread below that has a fox news insider link with a video (3:49 min) of Judge Nap on Varney & Co saying the FBI has had the server for a week and that all can be revealed - they can get to anything that was deleted.

Hey, I know. Have it filed for review/hearings by the same judge as Patreus (sp?). Let’s see just how ‘equal under the Law’ (D) vs. (R).

I have no illusions if it were Serf vs. elite unfortunately.

The whole “not classified at the time of sending” thing is misdirection. The WaPo published that as a question to be asked. And what a coinkydink - Hitlery answered it.

There is a legal loophole there. Like what the definition of “is” is.

My guess at the loophole is this. Say I am SOS and I write some new memo, letter, email, etc., that is Top Secret. “Technically” it may not be classified until I (or someone) decide what level classification it should have and then add the markings to it. If I write “We are going to start bombing the Russians at 2 a.m. on Jan 1, 2015” at which point does it become classified? “We are going to start” is obviously not classified.

If you watch very carefully, most of the Democrats lie in such a way that prosecuting them would be difficult because of the way they word things. They don’t say things like “I have never cheated on my wife.” They say things like “My wife trusts me.” (That has no bearing on whether or not I’m having an affair. My wife is just as dumb as the average democrat.). “I am not having an affair with Jane Doe” (because it’s someone else or because the affair is over at this time). “I have never had sex with Monica Lewinsky” (because I don’t define anything except intercourse as “sex”).

Well put! The misdirection will be directed at the public, while the vagueness will be used to hamper questioning and fact finding.

Hillary Clinton and her people are true geniuses at this (they’ve had practice).

Compared to Hillary’s crimes, sure.

In the context of him being the lead general in Afghanistan while men were dying under his command, the dalliance is not very forgivable. Wonder how many would have lived had his mind been on business as was his duty.

Noobie: You are forgetting that this was under that that arrogant pos occupant of 1600 Pennsylvania Ave who did not give him what he needed. As a matter of fact the entire Afghanistan US casualty under President Bush43 was 633 while under 0bama the US casualty list has in less than 6 years and 7 month already reached 1,733. You are also forgetting that the surge in Iraq which was under him was highly successful
