Why Hasn’t Louis Farrakhan Been Arrested Yet?

It’s been nearly a week since Nation of Islam Leader Louis Farrakhan called on his followers to rise up and kill their perceived enemies, and the silence of the Obama Justice Department has been deafening. Likewise, the MSM has been shamefully quiet, too — as if this is acceptable behavior for the leader of a 50,000-strong denomination. It most certainly isn’t.

Farrakhan’s shocking words came during a July 30 speech at Mt. Zion Baptist Church in Miami:

“The Koran teaches persecution is worse than slaughter. Then it says, retaliation is prescribed in matters of the slain. Retaliation is a prescription from God to calm the breaths of those whose children have been slain,” Farrakhan said.

“So if the federal government will not intercede in our affairs, then we must rise up and kill those who kill us. Stalk them and kill them and let them feel the pain of death that we are feeling,” he added.

In case the message wasn’t clear enough, the hateful clip was posted on Farrakhan’s Facebook page Monday with the blunt hashtag “#JusticeOrElse.”

The question posed was why was he not arrested. I answered that. Of course he is a lunatic but he has a disciplined following and discipline is important for revolution.

Not really. All that needs to be proven is what you are saying has a high probability of inciting others to take imminent lawless action (Post 19). Imminent does not mean action in progress.

Thanks. All of those parameters are subject to legal definition and action within local contexts. If someone cases to file charges at this time, they are free to do so. Would like to be first and do so immediately? What do you think the chances would be when it comes to winning your case?

Yes, difficult. Especially since, like obscenity, it is heavily dependent upon local standards, and realistically speaking, the chance of prosecuting, let along convicting Fara-can-can is almost zero.

Of course, if YOU said the same thing about murdering Black people you would be arrested faster than a chocolate eclair disappears off of moochells plate.

Perhaps, but people have been hunted down and arrested for much less for posting on social media. But hey, “prosecutorial discretion”.

the threat of violence has to meet specific criteria before it rises to the level of unprotected speech. specifically, it must incite imminent lawless action which Farakhan has been very careful not to do. By contrast, Louis Head’s repeated calls to “burn this bitch down” in Ferguson Missouri did rise to the level of inciting imminent lawless action and yet no charges were brought against him either. The fact is, if a white person ever spoke thusly, the federal government would be all over them.

There’s no doubt that his speech incites random actors, via mass media, to commit acts of violence (stochastic terrorism) but to meet the imminence criteria of unprotected speech, I think he would have to say something along the lines of “Pick up your gun and go outside and start shooting white people right now!” as opposed to something like “the day is coming when black people will rise up and start making white people pay for their transgressions”. And again, there’s no way Obama’s justice department would intervene even if he did cross the threshold.
