Va. Republicans to fire McAuliffe’s Supreme Court pick, install their own

RICHMOND — Virginia Republicans will reject Gov. Terry McAuliffe’s pick for the state’s newest Supreme Court justice and install their own choice, igniting a political firestorm that will come to a head when lawmakers return to Richmond in two weeks.

McAuliffe’s nominee, Fairfax Circuit Court Judge Jane Marum Roush, has already been sworn in, meaning Republicans will take the rare step of unseating a justice after she has taken the bench.

Leaders of the GOP-controlled General Assembly announced they plan to elect Virginia Court of Appeals Judge Rossie D. Alston, Jr., who previously served on the Prince William County circuit court, during the next session on Aug. 17.

The vacancy was created with the retirement of Justice LeRoy F. Millette, Jr.

Because McAuliffe made the appointment during a recess in the General Assembly session, Roush’s term would expire 30 days after the start of the next session. Traditionally, lawmakers have elected the governor’s choice to a full 12-year term.

I don't like McAuliffe at all, but I think this is ridiculous. Judge Roush is an excellent jurist, and this is a disappointing turn of events and the worst sort of politicking. She is more than qualified and does not deserve to be removed.

For those not in the area, she has been on the bench for 23 years. She presided over the trial of Beltway sniper Lee Boyd Malvo.

If McAwful played it right, this wouldn’t be an issue. By recess appointing her, he basically screwed the pooch. Funny I never hear such sentiments when the roles are reversed.

If they can do this in Virginia, why can’t we do that now in Washington D.C.?

We don’t like Justice Kennedy, or Roberts, we don’t like obuma, Lynch, Boehner, McConnelly, .....

I want to do this.....we could all take a vote on FR find out who would be good for a certain office and put them in....

I would like to see Trump/Cruz or Cruz/Trump as Pres and V.P.

There's a difference between a good trial court judge and a good appellate or supreme court judge.

McAuliffe (D) spokesman Brian Coy accused Republicans of playing politics, in response to what he called a surprise rebuff of Roush.

“Republicans’ decision to throw a distinguished jurist of 23 years off of the Supreme Court with no job to return to is without precedent in Virginia history,” Coy said in a statement. “It is no surprise that Republicans in the General Assembly would politicize this process, but it’s a tragedy that it will cost Virginia the service of a qualified female Supreme Court justice.”

If the Roush judge is such a fabulous talent, she should have no trouble landing a position as rainmaker on an influential and prestigious law firm where her talents would receive suitable compensation. Why deny her the opportunity to earn to her potential Terry?

I thought of that, and perhaps McAuliffe should have consulted the legislature. Still, it’s still not Judge Roush’s fault. She knows the law and I think she would be a great addition to the state supreme court; I’ve seen her on the bench for years.

Historically, the Virginia General Assembly has never removed a sitting justice. The Virginia judicial selection process has been the subject of debate for some time.

In the WaPo story, you have to read almost to the end to find out that Rossie Alston, the Republican choice, is African American.

I have no idea about the merits of these two judges. But if McAuliffe failed to consult the Republican leadership, I am in favor of slapping him down. It is more than a little presumptuous to recess appoint someone for a 12 year term and expect the other party, which controls the legislature, to roll over.

I mean, who does Terry McAuliffe think he is ... Barack Obama?

Follow the law. Not the “way it’s always been”.
Judges are POLITICAL appointments. Get over the Justice is Blind cr*p.

If the Pubbies can legally remove the Lefty Gov’s recess appt, then do it. This should happen WAY more often.
To borrow from Mr Schlichter, it’s time for Conservatives to get medieval on the Libs. They HATE us, so let’s take it to ‘em now.

What exactly is politicking? Looks like the system is working as it should. McAuliffe tried to channel his inner Obama and took up his pen and phone, but it doesn't work, not unless he had Boehner and McConnell on his side in that State House and State Senate.

Yes, and they were subsequently elected by the General Assembly.

Perhaps?

It would appear that the legislature gets to elect supreme court justices in VA and yet the Governor appoints someone without checking with the legislature?

You ready to let Obama appoint the next President, or would you rather wait for the voters to decide?

I have no idea what the politics of the appointed judge actually are, but if she was appointed by a Democrat I’ll lay odds she isn’t a conservative.
