Trailer driver acquitted of most serious charge in fatal Route 28 crash

Eric Gonzalez-Huerta might have been responsible for a fatal accident on Route 28 last year, but his conduct was not “directly and substantially linked” to the crime, an Allegheny County judge ruled Friday.

Common Pleas Judge Beth A. Lazzara acquitted Gonzelez-Huerta, 23, of Louisville, Ky. of a third-degree felony charge of accident involving death or injury while not properly licensed, the most serious count he faced.

Lazzara found him guilty of 22 summary counts, including driving without a license, operating a vehicle without insurance and operating a vehicle with unsafe equipment, for which the judge ordered him to pay mandatory fines totaling $1,800.

Gonzalez-Huerta's day-long nonjury trial before Lazzara occurred on Tuesday.

Lazzara said Assistant District Attorney Aaron McKendry “failed to establish a direct link” between Gonzalez-Huerta's conduct and the death of Robert Lofink, 75, of Hampton on Nov. 21, 2014.

Police said Gonzalez-Huerta was hauling construction debris from Ford City to a McKees Rocks landfill when a wheel from his utility trailer detached along Route 28, bounced over the median and crashed through Lofink's car, killing him instantly.

Yeah, sure.
Another example of The Ministry Of Propaganda covering up a crime by an illegal alien.

Americans are being killed daily, but we don’t know it because The Ministry Of Propaganda either squashes the stories outright or purposely obscures the fact that an illegal alien was the perpetrator.

It was probably a crappy old trailer that was not maintained. Unsafe trailers are common. Not responsible ... WTF?

Minimum mandatory sentence waived by judge in Pittsburgh heroin case

At sentencing Wednesday, assistant district attorney Lawrence Sachs asked the court to send Lee to prison under a mandatory minimum penalty in Pennsylvania for having more than 1 gram of heroin and for having a firearm in proximity to drugs being sold.

But Common Pleas Judge Beth A. Lazzara refused, saying a June U.S. Supreme Court decision makes Pennsylvania’s sentencing scheme for mandatory penalties unconstitutional.

“I will not legislate from the bench,” she said.

And even though the judge said she could still send Lee to prison based on individualized sentencing — and that the maximum in his case was 15 years — she, instead, gave him a break.

Judge Lazzara ordered him to serve 18 months on home electronic monitoring to be followed by five years of probation.

And there you have the entire story in summary.

I’d say let it sink in but Huerta was doing one of those jobs Americans won’t do, AKA: Inspecting their DOT vehicle prior to going on the road. And, it appears that in this decision, the judge is telling the [presumably free-attorney] you DID NOT PRESENT A VALID ARGUMENT-—go back to school or ask FWOTUS for some legal advice!

It’s easier to penalize for regulatory infractions (failure to whatever, from getting a driver’s license to getting insurance) — harder to show something like negligence in maintaining a vehicle.

Pittsburgh has lots of Italians.
Relatively few Hispanics.

Had a Davey Tree Company or Eichenlaumb driver made such a mistake, would that merit a 1800.00 fine?
The humiliation this “judgement” affords the family and loved ones of the victim is just astounding....rounding off a stellar communist week.
