Kids Locked Up For Refusing To Have Lunch With Dad; Judge Compares Siblings To Charles Manson Cult
CBS Detroit ^ | July 9, 2015 | Uncredited

PONTIAC (WWJ) – An Oakland County judge has sent three children to a juvenile detention facility for failing to have a relationship with their father, saying it’s one of the worst cases of parental alienation she’s ever seen — even comparing the children to the Charles Manson cult.

Circuit Judge Lisa Gorcyca declared the children — ages 9, 10 and 15 — in civil contempt of court during a hearing on June 24. The children were taken into custody and hauled off to Children’s Village after declining to have lunch with their father.

“It’s a very troubling case, no doubt,” said WWJ Legal Analyst Charlie Langton. “But you have to go way back to get the whole story. This is not just a lunch with dad. This goes back well more than that.”

BTW after re-reading the complaint you linked to, the father was clearly filing a motion asking the mother to be jailed for contempt, be stripped of physical custody, and be awarded attorney fees.

http://everything-pr.com/omer-tsimhoni-maya-eibschitz-legal-case/258402/

Yes I see a long line of accusations and requests for judgement etc...but much of that stuff is kinda weak...hear say, assumtion, inferance, innuendo, and opinion.

So the father unloaded his lawyer with both barrels at the mother in court and hit the kids as collateral damage.

Yeah that’s gonna get the kids to love ya dad.

Maybe the items in the motion were brought up because the mother was doing all that stuff! There are at least two professionals who have agreed that the mother has been alienating the children from their father.

Basically, from whaf it looks like, the mother left with the children and took them to another country, then worked on the children to turn them against their father.

Are you saying you would just let that happen to your own children? You would just walk away because they didn’t want to see you, even tho it seemed that their mother was, really, psychologically abusing them by alienating them from you, as well as by keeping them from their father (which is a bad thing for children).

This all started when the children were very young: the final separation and divorce seem to have been 6 years ago, so even the oldest was 9 at the oldest when his mother might have started all this (and he may have been a couple of years younger). So it would in no way correspond to how a child would react if the divorce occurred when he or she was a teen.

And where would the children be if the mother was put in jail? All their relatives are in Israel. So if the mother was put in jail, the children would be in state care anyway. But it seems she may have avoided jail by changing her actions while the children did not.

There is no evidence that the father was abusive other than the boy’s statement but there is evidence the mother was manipulating the children to believe bad things about their father.

The children are continuing with the counseling so hopefully this will all be resolved.

And the father does **not** want to see them in state custody—the judge said she would have done this sooner in the process except for the father’s request that it not happen.

The son claims he saw his dad hit his mom....have you considered that he might be telling the truth?

As the only accusation of violence is the one statement from the 15 year old in court, and Maya doesn't seem like the kinda girl not to have used that behaviour IF it occurred, consideration is fairly low.

Maybe the items in the motion were brought up because the mother was doing all that stuff! There are at least two professionals who have agreed that the mother has been alienating the children from their father.

And maybe it was throwing crap at the wall to see what might stick.

Again...no legal action was taken against the mother other than to deny her contact with the kids

Basically, from whaf it looks like, the mother left with the children and took them to another country, then worked on the children to turn them against their father.

Not correct.

"What happened is that Mr. Tsimhoni took a job with GM in 2008. He moved to take a position in Israel and initially, Ms. Tsimhoni, who like Mr. Tsimhoni is originally from Israel, did not want to move back with him, even though both sets of grandparents lived in Israel.

“She decided not to come. Then she filed for divorce and stopped letting me see the kids or speak to the kids. After some months there was a reconciliation. She moved to Israel, we moved all of our belongings here and then one day she suddenly disappeared and took the kids. Next I heard from her she was in Michigan – not where we had lived, in Ann Arbor, but in Oakland County. That’s when the divorce proceedings began.”

Since then, the divorce was finalized and Mr. Tsimhoni has remarried and moved back to Michigan “in order to be next to the kids and mend the relationship with the kids.” Ms. Tsimhoni has not remarried.

The parents had joint legal custody and their mother has physical custody. “Since then, I’ve been seeing them regularly but always in supervised visits, sometimes with a professional and sometimes with my ex-wife present. She is poisoning them and the judge realized that.”

Are you saying you would just let that happen to your own children?

Let what happen?...let my kids be hauled off to make a legal point?..nope...and I wouldnt jet off to israel while they sat there for weeks either ...i'd be there every day....wouldnt you?

You would just walk away because they didn’t want to see you,

I said I would honor their wishes if they didnt want to see me.

even tho it seemed that their mother was, really, psychologically abusing them by alienating them from you, as well as by keeping them from their father (which is a bad thing for children).

I know some "fathers" who have no business around anyones children...much less their own...

And as I said....if they were having problems..they were most likely fighting in front of the kids.

And where would the children be if the mother was put in jail?

Either the mother was in contempt or not...if she was guilty she would have been jailed and the judge obviously would have done the same thing with the kids.

And why not be placed with their father?

All their relatives are in Israel.

Not sure about that one.....I read the grandparents live in Israel...and both he mother and father are from there....but the judge ordered no one from the mothers side of the family can visit the kids either...so I dont get what that means if there arent other reletives in the US.

Also of note...the children are all US citizens.

So if the mother was put in jail, the children would be in state care anyway.

So there in effect was no reason not to jail her for contempt if the Judge could have done it.

So logically...she was not found in contempt (at least for now)...that fell upon the children for their refusal to even eat a meal with their father in the cafateria.

But it seems she may have avoided jail by changing her actions while the children did not.

And thus she is removed from the picture and no longer has any influence over the children.....the current legal battle is now between the children and their father , although I read the mothers lawyer has filed a Writ of Habeas Corpus scheduled to be heard on July 15th.

There is no evidence that the father was abusive other than the boy’s statement but there is evidence the mother was manipulating the children to believe bad things about their father.

The statement remains none the less...so he is either lying or telling the truth.

The children are continuing with the counseling so hopefully this will all be resolved.

Slight correction...the children are undergoing state ordered psychiatric therapy....will this include drugs if need be?

And the father does **not** want to see them in state custody—

Why is he in Israel instead of visiting his children every day with the councilers?????

I'm going to go right ahead and make a prediction.

His next legal move will be for full custody and the return of his children to Israel.

I bet a dollar he is meeting with lawyers there checking into his options of getting his kids back under his control.

judge said she would have done this sooner in the process except for the father’s request that it not happen.

And thus he pressed the issue into court again, knowing full that it might result in his children being removed from their mother....I guess that blows away the notion that he wasnt perfectly willing to see them put into state custody rather than have them be with their mother.

I'm not so sure he loves his kids that much or whether he is just trying to punish the mother.

Like I said.....the next legal move will tell.

I have considered that the mom is psycho.....have you considered the father is a smooth talking douchebag with a good lawyer and a Judges ear?

You wrote, “I have considered that the mom is psycho.....have you considered the father is a smooth talking douchebag with a good lawyer and the judge’s ear?”

I simply looked at what there was evidence for, like 2 professional diagnoses about what was happening with the mother, etc.

You have access to the same info I do, so I guess we’ll have to agree to disagree.

What I don’t understand is if the judge has the power to incarcerate the children for contempt, why didn’t she use that power over the parent(s) who did the poisoning? There should be serious repercussions for this kind of contempt ,ie., raising a potential “Charles Manson cult” - it’s child abuse same as if the parent(s) were beating them with a club. If it is as bad as this story indicates, maybe the kids are better off at the detention center away from them. Sounds like the judge, in a Solomon’s choice moment, refused to play any more games.

The title is incorrect. The judge didn’t compare the kids to a Charles Manson cult she compared the mother and the kids to Charles Manson cult. And she’s right. Cult members shut out non-cult family members. They prefer to live in a world of their own creation with their own set of rules.

The primary effect of the judge’s action is to remove the children from their ‘cult leader’.

Whatever the reason for removing minor children- has there been a similar contemptpt threat to the mother? If not, wh not? The judge certainly could do that.

The court likely couldn’t determine that the mother was the source of their refusal just like the court couldn’t establish that Manson ordered the Tate murders.

A 5-year regime of disaffection and alienation will ensure the children exhibit the mother’s wishes without prompting.

The mother is mentally ill. She may have been able to control it while working but went full-on crazy during her divorce. Divorce placed her in a zero-sum, Marxist dialectic with the father which only fed her “it’s everyone’s fault but mine” which schizophrenics and bi-polars exhibit. My guess is she’s unemployed as well since she appears to have no sense of accountability to societal norms and requirements.

Told you.

“The attorney for the father, who lives in Israel, said she plans on filing a motion to grant him custody of the two boys and their sister.”

http://www.freep.com/story/news/local/michigan/oakland/2015/07/10/jailed-kids/29964437/

Notice he now lives in Israel...but yesterday he lived in Michigan to be with his kids.

Justa.....why has the Judge allowed the kids to be released?

Just yesterday they could rot untill they talked to their father?

Now they are going to summer camp.....could it be that the judge didnt want to have her ruling reversed on the 15th?

And this is also consistent with a man who loves his children and doesn’t want them to be abused by their mother.

Given that we have very limited access to information about this case, it is impossible for us to come to a definitive solution.

True...it’s very hard to judge what people are thinking when they take actions......but actions often speak for themselves...

As I predicted, the father is going for full custody and now he is claiming to live in Israel.(per the article I posted)

The judge has reversed herself and instead of keeping the kids in childrens village until the age of 18 if need be(until they talk to their father) as she previously ruled...she has now sent them to summer camp....to be specific “Jewish” summer camp.

So two weeks ago the judge was willing to detain the kids in childrens village until they talked to their father to his satisfaction and apologized.....and now today it’s “hey dont worry about it and go to summer camp”

The Judge is covering her own ass here....much better to change her previous ruling and save face rather than be publically overturned by another court.(which was likey to happen on the 15th)

As I have said a few times now....I question the motives of the father...he is still in israel....why isnt he here and even trying to talk to his kids every day?...he has full visitation rights.....why not visit and at the very least document how the children treat him?

Nah...this flip flop concerning the kids by the Judge screams she knew she was going to be over ruled...now she cant be overruled since the kids are no longer being held by the state.

Do you even see what the Judge has done here?

A) Do you believe the Judge had had a sudden change of heart?

Or B) is she worried about the negative PR based on her ruling?

Sorry but I’m voting “B”...why?....this is drawing uneeded attention to her court and so it’s time to turtle up and punt.

"And this is also consistent with a man who loves his children and doesn’t want them to be abused by their mother."

Or B...it also behaviour consistant with a male control freak who views people in his life as possessions that he owns.

"Given that we have very limited access to information about this case, it is impossible for us to come to a definitive solution.

Wait what?

Weren't you just defending the actions of the court and the father to assert his parental rights and claiming this was cut and dreid and settled case law?

As I said....something isnt right about this case....there is something we dont know yet....and if everything was above board and without question...why did the judge all the sudden reverse herself?

I know first hand some people dont deal with court orders and legal matters very well when it concerns their loved ones....some people get very emotional and do or say things they might otherwise not....

But now that it is confirmed that the father is moving to get full custody.....a statement from the mother like "daddy is going to try and take you away from me" to the children becomes a concrete action in the childrens eyes. I really dont see how this man is going to win his childrens love and acceptance by following this legal tract to remove them from their mothers care. I know first hand the bonds between mother and child are stronger the father and child. How does breaking these maternal bonds actually help the children?..we talk alot about dads...what about moms?

“Now they are going to summer camp.....could it be that the judge didnt want to have her ruling reversed on the 15th?”

Ummm, no.

“Gorcyca held the Friday hearing after attorneys moved for her to reconsider the decision and release the children. Crediting the father’s request, Gorcyca reportedly switched the children’s punishment Friday from a detention center to summer camp.

At the June 25 hearing, an attorney for the mother emphasized that his client had encouraged her son to meet with the father. Gorcyca called this too little, too late, however, and implied that Maya Eibschitz-Tsimhoni has brainwashed the children.

“You need to do a research program on Charlie Manson and the cult that he has,” the judge said. “Your behavior in the hall with me months ago, your behavior in this courtroom ... is unlike anything I’ve ever seen in any 46,000 cases.”

“With that, Gorcyca added that she would not let Eibschitz-Tsimhoni, an assistant professor of ophthalmology at the University of Michigan, visit her child in detention.

As for the length of that detention, the judge warned that it could last into the fall or for years.

“We’ll review it when school starts, and you may be going to school there,” the judge said.

“But their mother has poisoned her children with hatred of their father, and they refuse to even talk to him. “

That’s what is so cultic about it. They can’t meet him because they may discover that he doesn’t meet the mom’s narrative.
Part of cult behavior is alienating anyone who doesn’t fit the narrative.

The children were offered a choice. Have supervised lunch with their father or go to Juvie. They willingly chose to go to Juvie. It was their choice.
