I was not exactly disputing your opinion. My focus was on pointing out that SCOTUS can nuance on any subject. The congress & president together can make it impossible for SCOTUS to nuance their interpretation.
Which means, in other words, we can’t depend on SCOTUS to carry our water. Only way Obamacare goes down is by simply abolishing it by congress+president. When that happens, SCOTUS can not reverse a duly passed law abolishing Obamacare.
Nuance! SCOTUS proved in the two decisions last week that they don’t need nuance. There is no “nuance” in “the states”. There is no other way to honestly read it. But 5 lawless lawyers decided to cram some nuance where there was none in order to fit their liking.
This means that no matter what the congress or the president does, no matter how water tight the laws they write, SCOTUS will take it upon themselves to give us the laws they think we should have.
