Overthrow The Judicial Dictatorship
America's Survival ^ | Jun 27, 2015 | Cliff Kincaid

Posted on 06/28/2015 11:26:15 AM PDT by Ray76

Commentators have missed the real significance of Justice Antonin Scalia’s dissent in the gay marriage case. He calls the decision a judicial “Putsch,” an attempt to overthrow a form of government—ours. His dissent, joined by Justice Clarence Thomas, was written “to call attention to this Court’s threat to American democracy.”

Scalia understands the power and meaning of words and he chose the word “putsch” for a specific purpose.

Hence, Scalia is saying this was not only a blatant power grab and the creation of a “right” that does not exist, but a decision that depends on public ignorance about what is really taking place. It is our system of checks and balances and self-rule that has been undermined, he says.

In that sense, he is warning us that we need to understand the real significance of this decision, and go beyond all the commentators talking about “marriage equality” and “equal rights” for homosexuals. In effect, he is saying that the decision is really not about gay rights, but about the future of our constitutional republic, and the ability of the people to govern themselves rather than be governed by an elite panel making up laws and rights as they go.

Congress has oversight of the court and can impeach members. They won’t. That’s our Congress. Time to replace it.

From Justice Scalia, 6/26/15: The Judiciary is the “least dangerous” of the federal branches because it has “neither Force nor Will, but merely judgment; and must ultimately depend upon the aid of the executive arm” and the States, “even for the efficacy of its judgments.”26 With each decision of ours that takes from the People a question properly left to them—with each decision that is unabashedly based not on law, but on the “reasoned judgment” of a bare majority of this Court—we move one step closer to being reminded of our impotence.

Imagine if one could use a time machine and bring Gen. George Washington from the Winter at Valley Forge to the present and show him what would become of his dream for a new country in less than 250 years. He would have given up and surrendered on the spot.

Seems to me that Roberts was right about one thing - Obamacare is a tax. But then he modified the words - and said as I recall - that it wasn’t the job of the SCOTUS to reject laws approved by the people. HUH? And then for this ruling they ignored the actual very specific words and inferred “context”. I’m no legal scholar but I thought they were supposed to approve or disapprove laws based on whether or not they - AS WRITTEN - adhere to the Constitution. Isn’t that what they swore an oath for?

As for the tax part - and probably why the rats plus the GOPe have no intention of demolishing the har de harr harr “Affordable Care Act” here is something I was sent this a.m.

Reminder for those who forgot or for many that didn’t know Here is what happened on January 1, 2015 :

• Top Medicare tax went from 1.45% to 2.35%
• Top Income tax bracket went from 35% to 39.6%
• Top Income payroll tax went from 37.4% to 52.2%
• Capital Gains tax went from 15% to 28%
• Dividends tax went from 15% to 39.6%
• Estate tax went from 0% to 55%

Remember this fact:

These taxes were all passed under the Affordable
Care Act, aka Obamacare.

If you think that it is important that everyone in the U.S. should know this, pass it on.

Where do u get the 4% figure?...i believe wicki has it at 1.6% I think it was here at FR i saw a survey where people were asked what % of the population is gay.......The average answer was 23%......I have asked many liberals the same question and they all say from 20 to 30%!!!!!!! try it! its amazing!!.... when confronted with the truth they get defensive!!!....it hurts their egos badly...when their positions fail...their self-esteem goes with it...hence you cant use logic or common sense with them...

Good read. If traditional values are of no importance, then the nation that has been our traditional home is probably not worth defending to some people.

One can only wonder as threats build over the next twenty years, if there will be anyone willing to defend against them.

Job complete, for the Liberal Left.

No, I don’t think he’s hanging around a strange crowd. Almost 60% favored gay marriage and my co workers are the same. There is no intellectual curiosity or even wanting to understand basic constitutional ideals. This is not going to be reversed in any manner and I can assume you know what is next. Everyone will be forced to embrace it and celebrate it. This country’s businesses will be under siege to submit and no one will come to their rescue.

Agree. No more can states exist with a federal Govt which is tyrannical and does not even obey their own laws.

Obama has ripped this country apart, whether it is the battle flag, homosexuality, immigration, drugs , race etc.

The media have helped him all along and now we see a tide, a frenzy in this country which I have never seen, and all being carried out by millions of people looking to intimidate, attack, and destroy what the country was founded on.

The image the media gives out makes it look like homosexuals are everywhere, when infact they are not.

I do not know anyone who favors the SCOTUS queer right’s decision.
I do not know anyone who favors the SCOTUS healthcare decision.
I guess I am just more selective of who I hang with.
Some people chose to hang with a strange crowd.

Thanks for the ping, Jim...

Either Congress reins in the Judiciary, or the states will assemble in convention and do it for them.

^^THAT^^

What’s our plan to insure one, or the other, happens?

How do we hold Congress accountable to rein in the Judiciary...to pass a law that gives States back their rights that supersede the overreach of SCOTUS? They haven’t listened to us in the last 7 years....how do we do this?

Next, what is our plan to spread the word about a COS? (other than preaching to our own choir?)
