My understanding of these laws is limited. But he hasn’t been convicted of anything. AFAIK, being charged but not convicted of a crime doesn’t remove any legal rights. Innocent until proven and all that.
Now there may very well be some civil liability for giving a gun to an unstable person.

Not complete information yet, but if the kid was addicted to or an unlawful user of a controlled substance, he was ineligible to purchase a firearm. His arrest would indicate he was using the substance (a prescription opiate) unlawfully. Additionally, if he is charged with a crime, not convicted or charged with a felony, carrying a possible sentence of more than one year, he's ineligible to purchase a firearm. Don't know if what he's charged with was over one year. If he's ineligible to purchase, he's ineligible to receive the gift, and dad is potentially facing a federal felony. I suspect dad will have trouble establishing he had no knowledge of his son's drug/legal problems, though I'm not certain that would matter. Civilly, I suspect dad has very serious problems due to the transfer, and given the nature of the crime and the Justice Dept, may have criminal issues as well.
Speaking of which, other advanced countries don’t have a lying murdering traitor as their head of state.
