Biker attorney seeks to replace judges, demands immediate release of clients

An attorney for two men arrested in the May 17 Twin Peaks shootout between rival bikers says his clients are being held illegally and is seeking to replace all McLennan County judges connected to the case.

Austin attorney Adam Reposa alleges in motions filed Tuesday that the charging documents filed against his clients, and the 168 others jailed in the chaotic melee, are legally insufficient.

He also claims that the $1 million bonds are unreasonably oppressive and that the judge who set them and the judges who, so far, have not reduced them have shown bias and should be recused.

Reposa represents Jimmy Pond and Thomas Paul Landers. He said Pond, a mechanic from Hays County, is the sole supporter of his family, which includes a disabled wife and autistic son.

Besides the recusal motion, Reposa filed an application for writ of habeas corpus, alleging a client is being held illegally and without proper cause, and a motion for emergency release so Pond can go home and take care of his family.

After the shootout, in which nine were killed and 18 wounded, Reposa said officials “commandeered” the Waco Convention Center as a makeshift holding area while they tried to sort out the magnitude of the event.

Yes I can explain those that have been arrested not cooperating. You have 115 people with no prior arrest records being held with a one million dollar bail pending charges of organized crime and possibly murder. That I can guarantee you will get you zero cooperation.

This is gross abuse of power by the state.

I did not see Reeves among the list of the deceased. Did his son use another name?

In any case, I do also grieve for any father or mother who has lost a son.

You refer to by inference, of course, more than to LE, to the cartels and their protectors, who terrorize border towns, and isolated farmers and ranchers near the border.

They be people too! And criminal gangs on our own soil are supporting the terrorizing of our own people, in their own homes, on their own farms and ranches, and I respectfully submit that the American Experience invested in farms, ranches, and small towns precedes and exceeds by any measure, the mythology of the Outlaw MC gangs as authentic American culture.

Not personal to you, just a place to post an observation — deeply held, mind you.

Yeah, just a little bit on the rabid side.

As of right now, on this thread alone he has 78 posts. Kinda vocal for someone who's been here less than 2 years.

I hope they aren't paying him much.because he's really not helping his side at all.

Although I have reread a number of the sources, I didn’t see this one, but accepting it on face value, what a remarkable thing for a mother who lost a child to say!

I say, in the absence of evidence to the contrary [which is heretofore not forthcoming, and when / if it is forthcoming I will acknowledge it], the cops likely did indeed save lives.

If this were a mere “turkey shoot,” another second or two much less ten, the number of killed would not be 9 but maybe, what? 40? And — not to me — but to the press — nine, forty? Just saying!

Despite some comments to the contrary that this was a “turkey shoot” — if that is what LE had intended, the body count sadly could have been, would have been, much larger.

I’ve read the CTH article and there are a few issues with their analysis...

First IIRC about halfway down with the photo showing the gray truck and the silver blob above the wheel arch that they claim are bullet holes from automatic fire. Looking at that photo, bullet holes are not going to be bright chrome silver as circled in the pic. IMO what they circled was a mirror and because of glare, angle and focal point it made it into a shapeless blob. Now what are possible bullet holes are the two circular marks between the silver blob and the tail light, and based on size I’d say about a 9mm.

The other photo was I guess from street level looking across the “grassy knoll” with the orange cones by the lightpole claiming that it marks the location of casings. How do they know that? It could be a candy wrapper or a steaming pile of dog sh*t for all anyone knows, but because those cones are there doesn’t mean that marks the location of spent casings. And even if a marksman was there he would have been an idiot because of ZERO cover and ZERO concealment.

As far as the video not being released, I’d only be concerned IF it was at the direction of the feds. If it was the local DA, I wouldn’t worry because A.) The investigation is ongoing. And B.) He doesn’t want to taint the jury pool for when this mess goes to trial because the defense attorneys will scream for dismissal.

I’m pretty sure that they are going over every camera angle to see who shot first, and the book will be thrown at him, the others would have fired in self defense, and the cops engaged the active shooters after the shooting began to end the whole thing.

They will get their bail hearings. They are filing writs of Habeus Corpus now. This was the practice ever since the Habeus Corpus Act.
