Pennsylvania law asks for me to be penalized if I am confirmed as holding a cell phone in hand while behind the wheel of a car, why not make it the rule for those controlling the train to do the same?It is. Required to be turned off and stored out of reach. If he was on the phone or texting while operating the train it's a crime and has been since 2008's Chatsworth head-on crash that killed 25 people on a commuter train due to the engineers texting and missing a red stop signal.

From what I understand, the Amtrak 188 is of the GE Genesis P32A-DM. It is one that is designed with low profile that enables it to go under tunnels with lower heights. Here is a photo of the locomotive's cab. The engineer sits on the right side because most signs and signals are on that side of the track.
With those large throttle controls, it would be difficult for someone to mistakenly put the throttle in the wrong position. However, how many of us have dosed off on the keyboard and woke up to pages of "z's" in the document. I think Bostian similarly dosed off and leaned forward on the controls. He woke up to his assistant conductor yelling at him to "Wake up!" The only thing he has left was to apply the brakes.
Where is that assistant conductor? There are two seats in that control cab.

If so, was he in communications with someone at the time of the accident, and what was the nature of those communications?And did those communications possibly contribute to the accident, either as a distraction emotionally, or just from the act of communicating distracting him from his job?

It's been a crime in California, however, I don't see anywhere that it's a crime in the Federal Code.
There is an FRA regulation that went into effect on March 28, 2011. However, the FRA ban involves civil penalties only [it is not a crime.] The civil penalties are not terribly severe.

That is a good point. A Google search for
suicide statistics gay vs straight will provide plenty of information of the much higher suicide and suicide attempt rates for homosexuals vs. heterosexuals.
