So your claim would be he was knocked out and had amnesia? Seems an argument of convenience. Kids throwing bricks just happen to hit him perfectly and totally knock him out. He happens to fall forward and accelerate the train. Some non-knocked out anonymous person pulls the emergency brake (how did they know how???). The guy gets a concussion and amnesia.
I seriously doubt it. But yes, let the investigation happen. Even when things seem obvious, a guy is innocent until proven guilty. But this one has guilty written all over it. We’ll see.

its a short step from throwing rocks at a train and firing at it..
if the engineer had head wonds...they may not have been form a rock...but some other sort of PROJECTILE.

Post-traumatic amnesia is a common concussion symptom. The fact that he doesn't remember what happened is consistent with traumatic brain injury: http://en.wikipedia.org/wiki/Post-traumatic_amnesia. He may very well recover those memories.

From what I have read, I understand that there was only one person in position to control the train. How could this be true when over 200 people are under his watch? Correct me if I am wrong.
Yes, when the head injury is serious enough to send the person to the hospital. My brother had some of that when he was in a car accident. He was also in a coma for several days, in ICU for about a month and in rehab for several months.
This guy was with it enough to run home and get a lawyer. If you have that sort of amnesia, you don’t only forget the important part. You forget why you are there, events before and after, that you even work on that train....etc.
Plus how does he have a memory to lawyer up and where to go for that but he does not remember anything else.
I agree. No matter guilt or innocence, I will lawyer up given the chance. Not worth the hassle of a government employee, sworn or not, pushing you into a corner.
A blood thirsty lawyer at least can protect my rights from them.
And for the people who think this comment means I hate cops: I don’t, but it is logic that if a cop is charging you, somewhere in his mind, he thinks you did it, and his operating premise is as such. A lawyer can protect you from that to some extent.
I always get lawyers for tickets (the extent of my experience on the wrong side of the law :)), since a cop is going to write the maximum ticket level he can, it’s his job. A good lawyer can persuade a D.A. to knock off some charges.
