This is a stupid lawsuit. It was a company-issued phone...she had no right to install or remove any app without permission of her company.
If she's complaining about her company monitoring her when she's off-duty, then turn the blasted phone off or leave it at home when off-duty. Or if the company requires her to have her phone with her at all times, spend a couple of bucks and use this:

Turning smart phones off does nothing to turn these apps off Smart phones are traceable on or off. and one cannot take out the battery. Who said we are not becoming watched slaves?

You’re right, and that’s a shame; workers have lost a lot of ground in the past decades in terms of work/life balances. I hate my job, but realize it is one of the few 40 hour per week jobs left; we are on call IF we have a company-issued phone, so I don’t use one - any attempt to force one on me would have to be accompanied by a large pay increase. I no longer work beyond my scheduled hours, and will have to react only if I’m forced to train someone in the more sensitive areas of my work. My company has no reason to expect me to respond outside of those hours unless it is part of the disaster recovery plan (as happened after Hurricane Sandy a few years ago); I increased my hourly wages significantly by ending the 6-6 schedule I worked years ago (when resources - money - were sent to female office toys of men in high positions instead of real workers).

Maybe iPhones are continuously on, but the anti-theft tracker application (Lookout) I have on my Android does not have the ability to track the location when the phone is off (and yes, I've tested it a few times -- it reports the location when the phone was turned off).

Personally, I refuse to deal with trivial garbage outside of business hours.
