Well that goes without saying, but if all of a sudden Obama Nationalizes the National Guard and we haven’t been attacked or are not “at war” I am sure my spine will be shivering....

Yeah, I know the ominous aspects of this, but the greater worry is the smuggled WMD scenarios in which a deployment of special forces domestically would be needed.
A president will never federalize a state’s National Guard for no reason. There will be a natural disaster or an insurrection going on at the time for such a thing to happen.
Unless the law has been changed the president can’t Federalize the Nat. Guard unless the governor of said state gives permission. Some here might recall that Pres. Bush wanted to Federalize the Nat. Guard during Katrina but Gov. Blanco refused for several days allowing the mess to get much worse.

I have no idea. I’ve been under the impression that a president doesn’t have to ask a governor’s permission to federalize his National Guard based on those two incidents from my youth. If the law has changed, I don’t know about it. Maybe it has.
The federal grab of the states’ National Guard units was “legitimized” around WWI.
