Rule Change May Devastate International Travel for Hunters and Shooters

Exporting firearms and ammunition from the U.S. normally requires a license--from the State Department for rifles, handguns, and rifle or handgun ammunition, and from the Commerce Department for shotguns and shotshells. But for many years, the State Department’s International Trafficking in Arms Regulations (ITAR) have allowed Americans to temporarily export up to three non-automatic firearms and up to 1,000 rounds of ammunition without a permit, as long as the firearms were declared and presented to a Customs officer. This was done by bringing the firearms to a Customs office at some point before the trip and completing Customs Form 4457--a form that can be completed for any personal property and that is normally used to prove that the traveler owned the property before going abroad, thus protecting the traveler from paying import duties on items already owned. The traveler would retain the form and present it upon reentry if needed.

But a 2012 State Department rule change added an important new requirement that the traveler declare rifles or handguns “upon each departure” by presenting documentation generated through the Commerce Department’s “Automated Export System” (AES)--an online reporting tool designed for use by businesses. (Non-“combat” shotguns are not regulated by the State Department, so the AES requirement does not apply to temporary shotgun exports.) The rule change was buried in a Federal Register notice aimed at authorizing the temporary export of gas masks by government employees and contractors.

Fortunately, the change was never enforced—until now. In postings on the Immigration and Customs Enforcement (ICE) website and in internal ICE documents obtained by NRA-ILA, ICE makes clear that it has begun enforcing the rule change. Form 4457 may no longer be used for firearms, and electronic declarations will be the norm.

traveled a couple times to canada, europe and africa with firearms.

the US part wasn’t that big a deal, i went to the customs office and filled out a form for the firearms, the scopes and my binocs so i could reimport them.
didn’t need that form to leave the US, sailed thru.

big issue in amsterdam, you need a special license even if the gun case is just changing planes, like flying on to africa. that was a pain to get in advance, especially from the US. also, since the license has to go with the guns, and you aren’t going to be there with the gun case as you change planes in amsterdam, you have to leave the case unlocked, i didn’t like that but it turned out not to be an issue.

had some issue on the return flight from africa with a limit on the amount of ammo that could be in luggage, i think it was no more than 20 or 40 rounds, so we had to ditch some at the airport.

returning to the US, customs sometimes looked in the case sometimes not, but it took all of like a minute to roll thru. they seemed more concerned with not showing the guns in the custom line and freaking the good citizens out, than checking anything. pretty much wanted to just move us thru. very polite, no issues, no big deal.

interstingly, going into canada, i found no issue whatsoever, twice, we just blew thru customs, once they didnt even look at the guns or the documentation, didn’t even open the gun cases. guns? no problem, come on it=n, enjoy the hunt ! one time the guy looked at my rifle and scope, and turned out he was a hunter and we had a little friendly discussion of the make and model, very pleasant. this was in alberta, they are a pretty cool crew there. Canada did collect a fee per weapon though, i think it was a couple bucks.

not sure if this new thing will be a pain, but the old system wasn’t that big a deal.

i guess i have found traveling with guns a lot less of a problem than you might think.

Alaska guides sometimes receive very nice rifles as ‘tips’ from wealthy Europeans on big-time hunting trips. Saves them from the extreme hassle of taking their guns back to Europe.

They are doing their best to make us all outlaws. I guarantee terrorists and criminals are not filling out any forms; soon the law abiding will have to ignore the laws if they want to live their lives.
