Arizona Passes Two Bills Aimed At Blocking Federal Laws (Executive Order)

House Bill 2368, introduced by Republican Representative Bob Thorpe of Flagstaff, Arizona, was passed this Wednesday by the Arizona House. House Bill 2368 seeks to bar the state of Arizona from funding any executive orders issued by President Obama, or policy directives issued by the Department of Justice.

According to the Arizona State Legislature website, the bill includes the following provisions:

"1. Prohibits this state or any of its political subdivisions from using any personnel or financial resources to enforce, administer or cooperate with an executive order issued by the President of the U.S. that has not been affirmed by a vote of Congress and signed into law as prescribed by the U.S. Constitution.

2. Prohibits this state or any of its political subdivisions from using any personnel or financial resources to enforce, administer or cooperate with a policy directive issued by the U.S. DOJ to law enforcement agencies in this state that has not been affirmed by a vote of Congress and signed into law as prescribed by the U.S. Constitution."

If the bill becomes a law, Arizona would essentially be independent of federal laws.

Republican Representative Justin Olson of Mesa, Arizona, introduced a similar bill, House Bill 2643, which seeks to stop state and local governments from using financial resources to enforce and implement the Affordable Care Act, as reported by KVOA News. House Bill 2643 was also passed by the Arizona House and will move to the Senate.

No, if the bill becomes a law, Arizona would essentially be independent of any executive order issued by the President of the U.S. that has not been affirmed by a vote of Congress and signed into law as prescribed by the U.S. Constitution.

The title is misleading - that’s the reason the (executive order) in the title was added. It is a reaction to amnesty by executive order.

That’s how I read it too. The “conclusion” there is wrong and merely meant to incite reaction. The AZ laws appear to be saying they will *only* actively support federal laws codified by legislation passed by Congress. Sounds reasonable to me. They are very definitely saying they won’t kowtow to some wanna-be dictator and his flunkies.

EOs are not laws. They only affect as orders to federal agencies, not others and definitely not civilians

With all due respect to AZ freepers, please consider the following.

Note the irony of the AZ bill with respect to its attempt to shield AZ from major problems with unconstitutionally big federal government, problems which are traceable back to the ill-conceived 17th Amendment (17A), versus AZ’s infamous RINO Senator Juan McCain.

The problem that I have with the first provision in the bill is this. Who cares if an executive order is supported by Congress since Obama and Congress routinely ignore Congress's constitutional Article I, Section 8-limited powers anyway?

I’d like to see AZ reference the following two excerpts from Supreme Court case opinions in the bill.

AZ lawmakers need to lead the other states to put a stop to unconstitutional federal taxes, repealing 17A along the way.

Excellent! If all the states did this then it would effectively nullify all unlawful rules/laws passed by a rogue President. No state would be under any obligation to enforce those kind of unlawful orders.

This really should be in every states constitution already but no one anticipated a despotic President like the one we now have. I imagine impeachment would normally happen long before now. I still don’t know why it hasn’t yet except for the equally corrupt AG Holder.

I hope this bill passes and is signed into law by the Governor.

Damned lie. It would become a state that does not feel compelled to enforce executive decisions that run contrary to valid public laws.

It would be interesting to see how the Federal Courts tie themselves into knots trying to justify Executive branch edicts as having the same footing as a law duly passed by Congress and signed by the President.

Some articles that were posted #8 were better. I don’t think they really meant that AZ would be “independent of federal law”.
But the intended outcome would be as you said - exempt from unconstitutional Exec orders.

Arizona isn’t commenting on whether or not they are law. Arizona is saying no STATE funds or personnel may be used for that type of federal law.
So unless the courts rule the STATE must spend money to enforce every federal executive order, ARIZONA will be fine.

IE,, if Obama gives amnesty, Arizona is not impeding it. They are merely saying not a penny of Arizona money may work to assist that effort.
