Millions at risk of losing coverage in Supreme Court health law case

Meredith is one of about 6 million people whose subsidized insurance hangs in the balance as the Supreme Court takes up a case that poses the most serious challenge to the Affordable Care Act since the court found the law constitutional more than two years ago.

The plaintiffs in King v. Burwell insist that people who buy coverage on the federal exchange are not entitled to subsidies, noting that the law says financial help is available for those who enroll through exchanges “established by the State.” The Obama administration argues that Congress clearly intended to help everyone who qualifies for it. The oral arguments are scheduled for March 4.

About the only thing both sides agree on is that the subsidies are critical to the health-care law, whose second open enrollment season ended Sunday. If the Supreme Court bars subsidies for people in 34 states, some say the law will unravel and the number of uninsured will soar. Others say the White House and Congress may come up with a solution. And still others say that at least some states will rush to set up exchanges. But any alternative would raise a host of legal and practical questions and could be difficult to implement.

CNN reports that “53% of Jackson Hewitt clients who received subsidies have to repay part or all of it, with the largest being $12,000.”

This fiasco called “Obamacare” was providing either minimal coverage, or in some instances, no coverage at all, due to only a limited menu of covered procedures, and compulsory coverage of many other procedures or drugs that were of no use to large parts of the population that was supposedly being “given” this benefit, or the co-pays were so high that effectively all the health care was being paid out of pocket.

Whatever was the pretext under which this law was passed, has almost completely disappeared, like the snow in the spring rains, and we are hit with the deluge.

I don’t see this being the existential threat to Obamacare most do. If the SCOTUS rules that only state exchanges can qualify for subsidies, then each state will either set up a subsidy, pronto, or have tens of thousands of angry people beating the statehouse doors down because without it they can’t afford the insurance. It doesn’t automatically mean Obamacare is dead, and puts the issue in the state’s lap. And governors and state legislators certainly do not have the guts to stand up and to tell their constituents, “well, I guess you’re just screwed for living in this state, then...”.

That's right; the national taxpayers are.
But soon the taxpayers of the specific state that sets up a state exchange, will pay the monumental tab forever, all by themselves, after 2015, If I remember right.

And if the government decided to take over auto dealer sales, gave me a subsidized car I could not normally afford, and the USSC said no...I would be in danger of losing my car.

The subsidies are doomed to fail anyway no matter what the SC decides. Obamacare will crush HC for all starting at the bottom and steadily working it’s way up. We’ve all been lied to by a greedy democrat party and an absolute idiot of a president.
